Consenting to the Raising of Loans by certain Local Authorities from the State Advances Office.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this third day of December, 1917.

Present :
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board, during the present war with Germany, to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf), whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor-General in Council :

And whereas application has been made for the consent of the Governor-General in Council to enable the several local authorities mentioned in the Schedule hereto to borrow the sums set opposite the names of the said local authorities respectively, for the several purposes specified in the said Schedule, from the State Advances Office :

And whereas it is expedient that the precedent consent of the Governor-General in Council should issue :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing from the State Advances Office of the loans hereinafter mentioned by the several local authorities set out in the Schedule hereto for the purposes specified in the said Schedule ; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor-General in Council to the raising of the loans hereby authorized.

SCHEDULE.

Eltham Drainage Board, £250 : For constructing drainage-works.

Horowhenua County Council, £500 : For constructing a road in the Otawhiwhi Road Special-rating Area.

Moa Road Board, £100 : For metalling eleven chains of Ross Road.

Rangitikei County Council, £225 : For forming, bridging, and metalling a portion of Baggett’s Road.

Western Taieri Land Drainage Board, £4,000 : For constructing a pumping-station and embankments.

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the raising of the loans hereinafter mentioned by the several local authorities set out in the Schedule hereto, provided that the rate of interest at which the loans or any of them are to be raised shall in no case produce to the lender a return exceeding five and one-quarter pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor-General in Council to the raising of the loans hereby authorized.

Tuakau Town District not to be Part of County of Franklin.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this third day of December, 1917.

Present :
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS the Governor-General is satisfied that the population of the Tuakau Town District, in the County of Franklin, exceeds five hundred, and the Town Board of the said Tuakau Town District has made application that the said town district shall not form part of the County of Franklin, being the county within the boundaries of which it is situated :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers vested in him by the Town Boards Amendment Act, 1908 (No. 2), and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that, on and after the first day of April, one thousand nine hundred and eighteen, the Tuakau Town District shall not form part of the County of Franklin.

Validating Proceedings in connection with a Loan of £500 proposed to be raised by the Hokianga County Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this third day of December, 1917.

Present :
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS the Hokianga County Council, acting under and in pursuance of paragraph (e) of section sixteen of the Local Bodies’ Loans Act, 1913, lately proposed to raise a loan of five hundred pounds for the purpose of preparing the formation of and for metalling the Waimamaku Valley Road from the end of the metalling opposite Section 8, Block XIV, Waoku Survey District, to Powick’s gate on Section 1, Block XV, Waoku Survey District :

And whereas the ratepayers’ consent given under paragraph (e) of section sixteen aforesaid is irregular in that one of the subscribing ratepayers has attested the signatures of the other subscribers thereto :

And whereas it appears that the ratepayers have not been misled by the said irregularity, and it is expedient to validate the same :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the ratepayers’ consent to the raising of the said loan shall be valid to all intents and purposes as though the
