Regulations regarding Free Places in Secondary Schools and District High Schools.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of July, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by the Education Act, 1914, and all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice of the Executive Council of the said Dominion, doth hereby revoke the regulations made by Order in Council of the twenty-third day of August, one thousand nine hundred and fifteen, relating to the examination for junior free places in secondary schools, district high schools, and technical high schools, and also the regulations made by Order in Council of the second day of April, one thousand nine hundred and eight, relating to free places in secondary schools and district high schools, and in lieu of the latter doth hereby make the regulations set forth in the Schedule hereto; and doth prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette, except with respect to clause six of the Schedule hereto, which shall come into operation on the first day of January, one thousand nine hundred and eighteen.

SCHEDULE.

  1. A FREE place under these regulations is tenable at a secondary school or a district high school.

Such a free place is to be regarded as alternative with (not in addition to) a free place held on a corresponding qualification under the Regulations for Manual and Technical Instruction.

  1. A secondary school shall be held to provide free places within the meaning of section 97 of the Education Act, 1914, if, in accordance with the Act and these regulations, it admits to such free places all qualified pupils who wish to attend such secondary school, called in these regulations “the secondary school”; provided that if any pupil is resident outside the education district in which the secondary school is situated it shall be at the option of the governing body of such secondary school to admit or to refuse to admit such pupil to a free place.

JUNIOR FREE PLACES IN SECONDARY SCHOOLS AND DISTRICT HIGH SCHOOLS.

  1. Subject to these regulations a pupil shall be qualified to be a junior free pupil or the holder of a junior free place under the Act, if—

(a.) He is the holder of a Junior National Scholarship, or any other scholarship that the Minister shall approve for this purpose: Provided that the value of any such scholarship is not greater than £40 per annum in the case of any pupil who is obliged to live away from home in order to attend the secondary school or district high school, or than £15 per annum in any other case; or if

(b.) He has qualified for a free place in the Junior National Scholarship Examination on such pass conditions as the Minister may from time to time determine. (NOTE.—To qualify in this examination a candidate must obtain not less than 75 marks in English, not less than 50 marks in arithmetic, and a total of not less than 400 marks in the whole examination); or if

(c.) Being not over fifteen years of age on the 1st December preceding the date of his admission to a free place, he has obtained a certificate of proficiency as defined by regulations under the Act, or an equivalent or higher qualification.

  1. With regard to pupils qualified under clause 3 hereof—

(i.) The secondary school shall admit to a junior free place any pupil qualified under (a) or (b), unless such pupil can attend as a junior free pupil a secondary school nearer his home.

(ii.) The secondary school shall also admit any pupil qualified under (c), unless such pupil can attend a secondary school nearer his home, or unless it is shown to the satisfaction of the Minister that such pupil can obtain suitable instruction at a district high school or a technical high school.
