Consenting to the Raising of a Loan by the Council of the Borough of Waimate.

ORDER IN COUNCIL.

At the Government House at Wellington, this second day of July, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board, during the present war with Germany, to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf) whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor in Council:

And whereas application has been made for the consent of the Governor in Council to enable the Waimate Borough Council to borrow the sum of two thousand pounds by way of temporary loan:

And whereas it is expedient that the precedent consent of the Governor in Council should issue:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing of the said loan hereinbefore mentioned, by the Waimate Borough Council, provided that the rate of interest at which the loan is to be raised shall not produce to the lender a return exceeding five and one-quarter pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor-General in Council to the borrowing of the loan hereby authorized.

Declaring Portion of Upper Waioeka Track, in the Opotiki County, to be a County Road.

ORDER IN COUNCIL.

At the Government House at Wellington, this second day of July, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE.

ALL that portion of the Upper Waioeka Track, in the Auckland Land District, Opotiki County, commencing at its junction with the Opato Track, a point on the north-eastern boundary of Section 5 (reserve), Block XVI, Waioeka Survey District, and extending thence generally in a south-westerly direction, adjoining or passing through said Sections 5 and 4, Block XVI, Waioeka Survey District, and part Section 1, Block IV, Waioeka South Survey District, and terminating at a point on the north-western boundary of the said Section 1 where it is intersected by the Okurata Stream; being a distance of 2 miles 10 chains, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 42455, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

Declaring Portion of the Tutaetoko Track, in the Opotiki County, to be a County Road

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE.

ALL that portion of the Tutaetoko Track, in the Auckland Land District, Opotiki County, commencing at a point opposite the south-eastern corner of Section 7, Block III, Waioeka Survey District, and extending thence generally in a southerly direction, adjoining or passing through Oamaru No. 2B Block, Blocks IV and VIII, Waioeka Survey District, Sections 1 (scenic reserve) and 3, Block VIII, Waioeka Survey District, and terminating at a point on the boundary between said Section 3 and Section 4, Block VIII, Waioeka Survey District; being a distance of four miles, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 42456, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

Licensing the Marlborough Timber Company (Limited) to use and occupy a Part of the Foreshore at Mussel Beach, Te Waewae Bay, Southland, as a Site for a Wharf and Breakwater.

ORDER IN COUNCIL.

At the Government House at Wellington, this second day of July, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under the Harbours Act, 1908 (hereinafter called “the said Act”), the Marlborough Timber Company (Limited), (hereinafter called “the company”) has applied to the Governor-General in Council for a license under the said Act to occupy a part of the foreshore and land below low-water mark adjacent thereto at Mussel Beach, Te Waewae Bay, as a site for a wharf and breakwater; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited plans in the office of the Marine Department at Wellington (marked M.D. 4747), showing the area of foreshore and land below low-water mark intended to be occupied, and the manner in which it is proposed to erect the said wharf and breakwater: And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or
