And whereas application has been made for the consent of the Governor in Council to enable the several local authorities mentioned in the Schedule hereto to borrow the sums set opposite the names of the said local authorities respectively, for the several purposes specified in the said Schedule from the State Advances Office:

And whereas it is expedient that the precedent consent of the Governor in Council should issue:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing from the State Advances Department of the loans hereinafter mentioned by the several local authorities set out in the Schedule hereto, for the purposes specified in the said Schedule; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor in Council to the raising of the loans hereby authorized.

SCHEDULE.

HAWERA County Council, £800: For forming and metalling Albert and Arthur Streets.

Piako County Council, £3,250: For metalling Cussin’s and Whakahongi Roads.

Consenting to the Raising of Loans by certain Local Authorities.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-fifth day of June, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board, during the present war with Germany, to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf) whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor in Council:

And whereas application has been made for the consent of the Governor in Council to enable the several local authorities mentioned in the Schedule hereto to borrow the loans set out in column B therein: And whereas it is expedient that the precedent consent of the Governor in Council should issue:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing of the loans herein-after mentioned by the several local authorities set out in the Schedule hereto, provided that the rate of interest at which the loans or any of them are to be raised shall in no case produce to the lender a return exceeding five and one-quarter pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor in Council to the raising of the loans hereby authorized.

Declaring Portion of Road in Blocks IX and X. Patetere North Survey District, to be a Government Road.

At the Government House at Wellington, this twenty-fifth day of June, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a Government road.

SCHEDULE.

APPROXIMATE areas of the pieces of road declared a Government road:—

A. R. P. Adjoining or passing through
1 1 29·1 Mangakaretu No. 1E, Block IX.
9 2 10·9 Mangakaretu Nos. 1D No. 1, 1B No. 1, 1B No. 2, and 1A, Blocks IX and X.

Situated in Patetere North Survey District. (S.O. 17323.) In the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 41666, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured green.

Declaring Roads in Culverden Township, Amuri County, to be County Roads.

ORDER IN COUNCIL

At the Government House at Wellington, this twenty-fifth day of June, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of roads described in the Schedule hereto shall, on and after the date of this Order in Council, become county roads.

SCHEDULE.

APPROXIMATE area of the pieces of roads declared county roads: 14 acres.

Adjoining or passing through Sections 7, 31, 16, 39 to 41, and 43 to 53, Culverden Township, and being parts of Sections 113, 114, 222, and 223, Square 90, situated in Block VI, Culverden Survey District (Canterbury R.D.), Amuri County.

In the Canterbury Land District; as the same is more particularly delineated on the plan marked P.W.D. 42402, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

Jubilee Avenue Extension, in the Borough of Devonport, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor, by Order in Council, thinks fit to impose:
