Regulations under the Military Service Act, 1916.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House at Wellington, this eighteenth day of June, 1917.

Present:

His Excellency the Governor in Council.

I, ARTHUR WILLIAM DE BRITO SAVILE, Earl of Liverpool, the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of that Dominion, do hereby, in pursuance of the authority conferred upon me by the Military Service Act, 1916, and of all other powers and authorities enabling me in that behalf, make the following regulations under that Act, and declare that they shall come into operation on the publication thereof in the Gazette.

REGULATIONS.

HOME SERVICE BRANCH, NEW ZEALAND EXPEDITIONARY FORCE.

Posting.

  1. Reservists called up for military service under the Military Service Act, 1916, and recruits who voluntarily enlist, are attested into the Expeditionary Force for general service, and shall be posted to the branches of that Force in the following manner:—

(a.) All reservists and recruits who are certified by the Medical Boards, or Medical Officers authorized to examine and report on their physical condition, to be “fit for active service beyond the seas” (category A, B 1, and B 2) shall be posted to the Foreign Service Branch.

(b.) All reservists and recruits who are certified by the said Medical Boards to be “permanently unfit for active service beyond the seas,” but “fit for service in New Zealand in connection with or for the purposes of the present war” (categories C 1 and C 2) shall be posted to the Home Service Branch.

Transfers.

  1. Transfers between the branches of the New Zealand Expeditionary Force shall be carried out as follows:—

(a.) A reservist or recruit having been posted or transferred to the Home Service Branch, but subsequently certified by a duly authorized Medical Board to be “fit for active service beyond the seas,” shall be transferred from the Home Service Branch to the Foreign Service Branch.

(b.) A reservist or recruit having been posted or transferred to the Foreign Service Branch, but subsequently certified by a duly authorized Medical Board to be “permanently unfit for active service beyond the seas,” but “fit for service in New Zealand in connection with or for the purposes of the present war,” shall be transferred from the Foreign Service Branch to the Home Service Branch.

Conditions of Service in the Home Service Branch.

  1. Soldiers of the Home Service Branch will serve under precisely the same conditions as soldiers of the Foreign Service Branch, excepting that non-commissioned officers and men who are not quartered and rationed by the Department will be paid a lodging-allowance, as provided in Special General Order 174/1917; and that warrant rank will not be granted to any N.C.O. of the Home Service Branch.

Leave.

  1. Soldiers of the Home Service Branch who are not immediately required for service shall be granted leave without pay.

Actual Home Service.

  1. Until the Minister of Defence shall otherwise direct, soldiers of the Home Service Branch who are required for actual home service will be called up from those only who volunteer for such actual home service.
