First Schedule hereto, and of the Raglan County Council, being the local authority in whose district the said land is situated, proclaim as a road the land in Karioi Survey District described in the First Schedule hereto; and also do hereby, with the like consents as aforesaid, proclaim as closed the road described in the Second Schedule hereto, which is not required by reason of the road described in the First Schedule hereto.

All in the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 42308, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured as above mentioned.
Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this fourteenth day of June, in the year of our Lord one thousand nine hundred and seventeen.

Declaring Land taken for a Public Work, and not required for such Public Work, to be Crown Land.

A PROCLAMATION.
WHEREAS it is provided by section thirty of the Public Works Act, 1908, that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work the Governor may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions therein mentioned:
And whereas it is further provided by section five of the Public Works Amendment Act, 1909, that in the case of any land so taken, purchased, or acquired for a Government work and not required for that purpose the Governor may, on the recommendation of the Minister, and without complying with any other requirements of the aforesaid section thirty, by Proclamation declare such land to be Crown land subject to the Land Act, 1908, and thereupon the land may be administered and disposed of under that Act accordingly:
And whereas the land described in the Schedule hereto was taken for the purposes of a road: And whereas such road has been stopped, and it is desirable to declare the land contained therein to be Crown land:
And whereas a plan has been prepared, and the Minister has recommended the Governor to declare such land to be Crown land:
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon me by the above-in-part-recited Acts, and of all other powers in anywise enabling me in this behalf, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby declare the land described in the Schedule hereto to be Crown land subject to the Land Act, 1908, and that such land may be administered and disposed of under that Act accordingly.

SCHEDULE.
APPROXIMATE area of the piece of stopped road declared to be Crown land: 1 acre 2 roods 36 perches.
Adjoining or passing through Sections 1, Block XI, and 6, Block VII, Rangiriri Survey District. (S.O. 18939.)
In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 42029, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured green.

Portion of Marine Parade, in the Borough of Eastbourne, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this eighteenth day of June, 1917.
Present:
His Excellency the Governor in Council.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor by Order in Council thinks fit to impose:
And whereas the Eastbourne Borough Council, being the local authority having control of the portion of street described in the Schedule hereto, has passed the following resolution—viz., “That section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to that part of Marine Parade situate within the Eastbourne Borough shown on the plan attached hereto and coloured green, and being all the piece of land situate at Eastbourne, in the Provincial District of Wellington, containing two roods fourteen decimal two perches (2 roods 14·2 perches), being part Sections 37 and 39, Harbour District, and part of the land in certificates of title, Volume 185, folio 80, and Volume 199, folio 125”:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.
ALL that portion of Marine Parade situated in the Borough of Eastbourne, Wellington Land District, comprising an area of about 2 roods 14·2 perches, adjoining or passing through part of Sections 37 and 39, Harbour District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 41862, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured green.
