Vesting Exclusive Care and Control and Management of Portion of “Kawau Cut” Drain in the Palmerston North Borough Council.

A PROCLAMATION.

WHEREAS the Palmerston North Borough Council has made application for the issue of a Proclamation under section sixty-four of the Land Drainage Act, 1908, vesting the control of a certain portion of the drain known as the “Kawau Cut” in the Council:

And whereas it is expedient to issue the Proclamation as requested:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authority vested in me by section sixty-four of the Land Drainage Act, 1908, do hereby proclaim and direct that that portion of the drain known as the “Kawau Cut” extending south-westerly from the south-western boundary of the Borough of Palmerston North to the Awapuni Outlet shall from and after the first day of July, one thousand nine hundred and seventeen, be under the exclusive care, control, and management of the Palmerston North Borough Council.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this eighteenth day of June, in the year of our Lord one thousand nine hundred and seventeen.

Allocating Land reserved and taken for a Railway to the Purposes of a Road at Omahu, Thames County.

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto forms part of land taken for the purposes of the Waikato-Thames Railway, and it is considered desirable to allocate such land to the purposes of a road:

And whereas it has been certified by the Minister of Railways that such land is not required for railway purposes: And whereas such land is situated in the County of Thames, the local authority of which has assented to the issue of this Proclamation:

And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in me by section one hundred and ninety-seven of the Public Works Act, 1908, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Thames County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

APPROXIMATE area of the piece of land: 1 acre 2 roods 26·2 perches.

Portion of railway reserve (S.O. 19480, blue), Block IV, Waihou Survey District, Thames County.
