Block VII, Maketu Survey District, Paengaroa N. C 1 Block, Section 24, Block VIII, Maketu Survey District, by the Village of Paengaroa, across a public road, again by the said village, then by the north-western boundaries of Section 22, Block VIII, Maketu Survey District, Paengaroa N. B Block (Sections 1, 2, 3, 4, 5, 6, 7), across a public road, by the north-western boundaries of Sections 8 and 9, Paengaroa N. B Block aforesaid, and Sections 8, 7, and 2 of Block IV, Maketu Survey District, and by the road intersecting Rau-o-te-Huia Block and that road continued on in a north-easterly direction to the Okarito Block, and by the west, north, and north-eastern boundaries of said block; thence by the Ngamahau No. 1 Block, the Waiparapara No. 2 Block, and the Pa Waikato Block; thence by high-water mark of the Waihi Estuary in a northerly direction to the Bay of Plenty at a point in a north-westerly direction from the northernmost point of Pukehina A Section 1 Block, and thence across the Waihi Estuary to the point of commencement.

Regulations relating to the Constitution of the New Education Districts.
LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government House at Wellington, this nineteenth day of June, 1916.
Present:
His Excellency the Governor in Council.
IN pursuance and exercise of the power and authority conferred upon him by the Education Act, 1914, as amended by the Education Amendment Act, 1915 (No. 2) (hereinafter referred to as “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the purpose of providing for the transfer of the powers, duties, obligations, and functions of Education Boards hitherto existing to the Boards of Education Districts newly constituted under the said Act, and for financial and other adjustments consequent upon the constitution of such new districts.
REGULATIONS.

THE Board of each education district constituted under the said Act (hereinafter referred to as “the new Board” and “the new district”) shall from the date of its coming into existence be deemed to be the successor of the Board or Boards of the education district or districts existing at the commencement of the said Act (hereinafter individually referred to as “the old Board” and “the old district”) in so far as such old Board or Boards possessed the powers, duties, and functions imposed upon Education Boards by the said Act or any preceding Act within the new district, and the old Boards shall thereupon be dissolved.

On the coming into existence of any new Board under the said Act all existing contracts, debts, and liabilities of any old Board affecting any real or personal property which vested in the new Board by virtue of the said Act shall become the contracts, debts, and liabilities of the new Board, and all existing contracts, debts, and liabilities properly made or incurred by any old Board in the exercise of the powers and functions imposed upon it by the said Act or any Act thereby repealed in connection with the administration of education within the district of any new Board shall become the contracts, debts, and liabilities of the last-named Board.

For all purposes any new Board constituted under the said Act shall be deemed to be the same body corporate as any old Board of which it is deemed to be the successor.

The following provisions shall apply as from the date of coming into office of the members of the Board of a new district:—
(a.) All public schools, technical schools, technical and other classes, training colleges, offices, workshops, and other institutions and establishments situated within the new education district, and maintained and controlled by any old Board in accordance with the provisions of the said Act or any Act thereby repealed, shall be under the control and management of the Board of the new district.
(b.) All teachers, pupil-teachers, and probationers employed within the new district and holding office under an old Board at the time of coming into existence of the new Board shall, subject to removal in accordance with the said Act and to any express provisions thereof, continue to hold such office under the new Board.
(c.) The new Board shall, not later than the 22nd day of September, 1916, finally determine the positions and terms of engagement of the officers and other persons, except teachers, pupil-teachers, and probationers, who are in its employment in the new district, and whom it may decide to employ permanently, and shall at the same time forward to the Public Service Commissioner the name, position, qualifications, and salary of any of the aforesaid officers and persons whose services are not required in the new district, and whom it may recommend for appointment by the Commissioner under section 26 of the Act.
(d.) Generally the Board of the new district shall have and exercise all the powers, duties, and functions with respect to its district that are imposed upon Boards by the said Act.

Notwithstanding anything in the last preceding clause, where two or more education districts existing at the commencement of the said Act are combined to form a new education district constituted under the Act, the Secretary of the Board appointed in accordance with the regulations for the first election of members of Education Boards gazetted on the 24th February, 1916, to conduct the election of the new Board shall, unless and until the new Board shall otherwise determine, be the Secretary of the new Board.

Where the boundaries of an old education district are not coincident with the boundaries of a new education district the following provisions shall apply with respect to the accounts of the Board of the old district:—
(a.) The Board shall cause its accounts for the seven months ending 31st July, 1916, to be balanced, and true statements and accounts to be prepared, in the form provided by the Minister, of the receipts and expenditure during the period, and of its assets and liabilities as at the date aforesaid.
(b.) All such accounts shall be audited as provided by subsection (3) of section 38 of the said Act.
(c.) True copies in duplicate of such statements and accounts duly certified shall forthwith be sent to the Minister.
(d.) The old Board’s accounts shall be closed on the said 31st July, and no payments of money by the Board shall be made after that date, except such payments of the salaries and wages of teachers and other officers and servants for services up to and including the 31st July, 1916, as may be found necessary: Provided that, if the Minister so determines, where the alterations of the boundaries of any old district affect only a small portion of the district, the above provisions shall be deemed to be complied with if the Board prepares and submits statements and accounts for the period named relating to that portion only of the old district that is, owing to the constitution of the new districts, being separated from the remainder of the old district, and to the schools contained therein.
- Where the boundaries of an old district are not coincident with the boundaries of a new district the Board of the old district shall prepare the following lists and statements and forward them to the Director of Education before the 9th August, 1916. Such lists and statements, except as otherwise expressly provided, or as the Minister decides, shall relate only to such portions of the old districts as are separated from the principal area in terms of the said Act and to such districts as are included entirely in a newly constituted district; provided that where the principal office of an old Board is situated in the chief town of a new education district the information herein prescribed shall not be required.
(a.) A list of the public schools in the district, with their staff and salaries as payable at the 1st August, 1916, and the average attendance in each case for the year preceding.
(b.) A statement showing the allowances payable to School Committees for incidental purposes according to the scale adopted by the Board, and showing also the dates up to which such allowances are paid.
(c.) A list of the office staff and other officers employed by the Board, showing the salaries, length of service, conditions of appointment, and duties.
(d.) A list of the staff employed by the Board in the repair and erection of school buildings and in making furniture and other equipment, showing similar particulars as under (c).
(e.) A statement showing the amounts granted or owing to School Committees for school libraries and other
