Modifying License for Tram-line across New River Estuary.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifteenth
day of February, 1916.

Present :

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

WHEREAS by Order in Council dated the third day of
September, one thousand nine hundred and six, and
published in the New Zealand Gazette No. 76, of the sixth day
of the same month, the Invercargill Borough Council was
licensed to construct a tram-line across the New River Estuary
from Otatara to Invercargill, subject to the terms and condi-
tions contained in such Order in Council:

And whereas it is desirable to modify such terms and con-
ditions:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the Harbours
Act, 1908, and of every other power and authority enabling
him in that behalf, and acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby modify the said terms and conditions as follows—
namely: The terms and conditions hereinbefore referred to
are hereby varied by authorizing the suspension or discon-
tinuance of all passenger and goods traffic over the said tram-
line for a period not exceeding one year from the first day of
August, one thousand nine hundred and fifteen, and by
authorizing the said tram-line to be used during the said
period for the carriage of spoil and other material for the
purpose of carrying out the reclamation-works described in
an agreement made between the local authority and the
Minister of Justice for and on behalf of His Majesty the
King, and dated the twenty-ninth day of January, one
thousand nine hundred and ten.

Portion of the Southern Side of Gardner’s Valley Road, in
the Upper Moutere Road District, exempted from the
Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifteenth
day of February, 1916.

Present :

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908, it
is, inter alia, provided that the said section shall not apply
in any case where the local authority having control of
any road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved
by the Governor in Council:

And whereas by subsection two of section one hundred
and seventeen of the Public Works Act, 1908, and clause (b)
of subsection one of section thirteen of the Public Works
Amendment Act, 1911, it is provided that such approval may
be either absolute or subject to such conditions as the
Governor in Council thinks fit to impose, and may refer to
one or both sides of the road or street:

And whereas the Upper Moutere Road Board, the local
authority having control of the portion of road described in
the Schedule hereto (hereinafter referred to as “the said
portion of road”), has passed the following resolution—viz.,
“The Upper Moutere Road Board, being the local authority
having control of Gardner’s Valley Road, hereby resolves
that the provisions of section one hundred and seventeen of
the Public Works Act, 1908, shall not apply to that portion
of the southern side of the said road adjoining Sections 31,
32, and 33, Block XVI, Motueka Survey District”:

And whereas it is deemed expedient that such resolution
should be approved in so far as it refers to the southern side
of the portion of road described in the Schedule hereto.

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Acts, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution to the extent hereinbefore mentioned.


SCHEDULE.

ALL that portion of Gardner’s Valley Road, in the Nelson
Land District, Upper Moutere Road District, adjoining
Sections 31, 32, and 33, Moutere Hills, Block XVI, Motueka
Survey District. As the said portion of road is more par-
ticularly delineated on the plan marked P.W.D. 37874,
deposited in the office of the Minister of Public Works at
Wellington, in the Provincial District of Wellington, and
thereon coloured red.

Recreation Reserve in Wellington Land District brought under
Part II of the Public Reserves and Domains Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this eighth
day of February, 1916.

Present :

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

BY virtue of the powers and authorities vested in me by
the twenty-sixth section of the Public Reserves and
Domains Act, 1908, I, Arthur William de Brito Savile,
Earl of Liverpool, the Governor of the Dominion of New
Zealand, by and with the advice and consent of the Executive
Council of the said Dominion, do hereby order and declare
that the reserve for recreation in the Wellington Land
District described in the Schedule hereto shall be and the
same is hereby brought under the operation of and declared
to be subject to the provisions of Part II of the said Act;
and such reserve shall hereafter be known as part of the
Pohangina Domain, and be managed, administered, and
dealt with as a public domain.


SCHEDULE.

ALL that area in the Wellington Land District, containing
by admeasurement 5 acres, more or less, being Suburban
Section 32A, Town of Pohangina. Bounded towards the
north-west and north-east generally by a public road, 291·1
links, 362·7 links, 382·6 links, and 241·5 links; towards the
south-east by Suburban Section 32B, Town of Pohangina,
725·9 links; and towards the south-west by a public road,
789·2 links: be all the aforesaid linkages more or less. As
the same is delineated on the plan marked L. and S. 11/31,
deposited in the Head Office, Department of Lands and
Survey, at Wellington, and thereon bordered red.

Revoking Order in Council setting apart Land for Purposes
of the Workers’ Dwellings Act, 1910.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifteenth
day of February, 1916.

Present :

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

WHEREAS the area of land described in the Schedule
hereto is not required for the purposes of the
Workers’ Dwellings Act, 1910:

Now, therefore, in pursuance and exercise of every power
and authority enabling him in this behalf, His Excellency
the Governor of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council
thereof, doth hereby revoke the Order in Council made on
the fifth day of June, one thousand nine hundred and twelve,
and gazetted on the thirteenth day of June then instant,
setting apart such land for the purposes of the Workers’
Dwellings Act, 1910.


SCHEDULE.

ALL that area in the Hawke’s Bay Land District containing
by admeasurement 1 acre 1 rood 27 8/10 perches, more or less,
