Apportioning the Cost of Maintenance, &c., Eureka Outlet Drain and Connecting Drain, County of Waikato.

A PROCLAMATION.

WHEREAS under the provisions of the Land Drainage Act, 1908 (hereinafter termed “the said Act”), a Commissioner was appointed and an inquiry was duly held with a view to determining what amount should be paid by any local authority or local authorities for or towards the cost of managing, maintaining, repairing, improving, or reconstructing certain drains or watercourses running through or situated within the Eureka Drainage District, and also of all drainage-works connected therewith or appertaining thereto: And whereas such Commissioner did report to the Governor, after due inquiry, his opinion as to the matters respecting which he was appointed to report: And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby proclaim and direct as follows, that is to say:—

  1. That the drains in the County of Waikato, situated partly in the Eureka Drainage District, known as the “Eureka Outlet Drain” and “Connecting Drain” (hereinafter referred to as “the said drains”), the former extending from Allotment 21 to Allotment 156, Tamahere Parish, and the latter from Allotment 84 to the said “Eureka Outlet Drain,” shall from and after the date of this Proclamation be under the exclusive care, control, and management of the Eureka Drainage Board.

  2. I fix and determine that the Eureka Drainage Board, the Hautapu Drainage Board, and the Fencourt Drainage Board shall each pay one-third of the cost of managing, maintaining, improving, or reconstructing the said drains.

  3. I direct that any payments hereby required to be made by the said Hautapu Drainage Board and by the said Fencourt Drainage Board shall be paid from time to time in the proportions hereinbefore fixed and determined, out of the funds under the control of such Boards respectively, in each case within a period of thirty days after demand in writing made by or on behalf of the Eureka Drainage Board; and all such payments shall be made from time to time to the Clerk of the said Eureka Drainage Board for and on account of the said Hautapu Drainage Board and the said Fencourt Drainage Board respectively.

  4. I further direct that each of the said Drainage Boards shall pay to the Minister of Internal Affairs the sum of seventeen shillings and sixpence towards the cost and expenses of the said inquiry.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this eighth day of February, in the year of our Lord one thousand nine hundred and sixteen.

A PROCLAMATION.

WHEREAS the Land Board of the Nelson Land District has recommended that the Crown tenant of the land described in the Schedule hereto should be afforded relief, owing to exceptional circumstances over which he has no control preventing the profitable occupation of such land:

Now, therefore, in pursuance and exercise of the power and authority conferred upon me by section twenty-five of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1911, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby proclaim and declare the land described in the Schedule hereto to be subject to the provisions of
