Declaring Road-lines through Land in the Waikakahi Settlement, Canterbury Land District, to be closed.

LIVERPOOL, Governor.

WHEREAS a report has been received from the Surveyor-General, from which it appears that the roads described in the Schedule hereto are unformed and unused, and that the said roads intersect land acquired under the Land for Settlements Act, 1908, and are not suitable to the subdivision of such land:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of section eighty of the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do by this notice hereby close the roads hereinafter described; and I do hereby declare that the said roads shall thereupon become subject to the said Act.

Trustees for the Heathfield Public Cemetery appointed.

LIVERPOOL, Governor.

IN pursuance and exercise of the powers and authorities vested in me by the fourth section of the Cemeteries Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby appoint the several persons whose names are specified in Part I of the Schedule hereto to have the control and management of the public cemetery specified in Part II of the said Schedule.

Part II.—Name of Public Cemetery and Description of Land.

HEATHFIELD.

ALL that area in the Otago Land District, containing by admeasurement 9 acre; 0 roods 36 perches, more or less, being Section 4, Block X, Tautuku Survey District. Bounded towards the north generally by a public road, 1490 links; towards the south-east by Section 23 of said block, 1361·2 links; towards the south-west by a public road, 289·9 links; and towards the west by a public road, 905·6 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 2/297, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor, this thirtieth day of December, one thousand nine hundred and fifteen.

Warrant apportioning the Cost of Maintaining Part of the Waitotara Station Road between the Whenuakura–Waitotara Road Board and the Waitotara County Council.

LIVERPOOL, Governor.

WHEREAS by section one hundred and nine of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is provided that in any case where a road in one district is largely used by or for the purpose of traffic to or from any other district or districts, and affords access to or from such districts, and the Governor is of opinion that it is equitable that the latter district or districts should contribute towards the cost of construction or maintaining the whole or any portion of such road in the former district, the Governor may from time to time apportion the cost of constructing or maintaining the whole or any portion of such road among the local authorities of the respective districts as he thinks fit; and for that purpose and to enable effect to be given hereto, the provisions of section one hundred and nineteen hereof shall, mutatis mutandis, apply in the case of the construction or reconstruction of the road, and the provisions of section one hundred and twenty in the case of the maintenance of the road: And whereas it is provided in the said section one hundred and nine that the word “road” in that section includes, in the case of a borough, a street or other thoroughfare:

And whereas a dispute has arisen between the local authorities hereinafter mentioned on the question of the maintenance of the road hereinafter mentioned: And whereas by the said section one hundred and twenty it is, inter alia, provided that the Governor may, with a view of determining what proportion (if any) of the cost of maintaining any work should be borne by any local authority, direct any Magistrate or other person to be a Commissioner to inquire into and report to him upon any matter which he shall deem necessary to enable him to determine any such question as aforesaid:

And whereas a Commissioner was appointed for the purpose aforesaid, and an inquiry was duly held:

And whereas such Commissioner did report to the Governor, after due inquiry, his opinion thereon:

And whereas the Governor is of opinion that it is equitable that the cost of maintaining the road mentioned in the Schedule hereto should be provided and paid in the manner and in the proportion hereinafter set forth:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by the said Act, do hereby direct that from and after the date of this Warrant the cost of maintaining the road described in the Schedule hereto between the Whenuakura-Waitotara Road Board and the Waitotara County Council shall be borne in the following proportions—viz., the Whenuakura - Waitotara Road Board shall pay eighty-five per centum and the Waitotara County Council fifteen per centum of such cost respectively. And I do hereby direct that any contribution hereby required to be made as aforesaid by the Waitotara County Council shall be paid from time to time out of the funds of the said
