- (a.) The appellant on or before the last week-day before the day appointed for the sittings of the Court of Appeal at which the appeal is to be heard shall set down the appeal with the Registrar of the Court of Appeal, and at the same time file with the Registrar a duplicate of the notice of appeal and one copy of the case and evidence printed as aforesaid, and shall leave with him ten copies of such case and evidence for the use of the Judges of the Court of Appeal. The Registrar shall thereupon set down the appeal by entering the same in the list of appeals, and it shall come on to be heard according to its order in such list unless the Court of Appeal shall otherwise direct.
(b.) No appeal shall be deemed to be set down under this rule unless the printed copies are filed and left with the Registrar on or before the last day for setting down the appeal.
(c.) Except in the case of appeals under the Crimes Act, 1908, leave to set down otherwise than in accordance with this rule will only be granted upon good cause shown and upon such terms as the Court shall think proper.
(d.) In the event of non-compliance with this rule the Court of Appeal may, on the application of the respondent, make an order declaring that the appeal, or the notice of appeal, has been abandoned, or adjourning the appeal, and may in either case allow costs to the respondent.
(e.) The provisions of this rule shall apply, mutatis mutandis, to every case removed into the Court of Appeal under section 64 of the said Act.
