Portion of Reuben Avenue, Brooklyn, in the City of Wellington,
exempted from the Provisions of Section 117 of the Public
Works Act, 1908, subject to a Condition as to the Building-line.


LIVERPOOL, Governor.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this eighteenth
day of December, 1916.

Present:

THE HONOURABLE J. ALLEN PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908,
it is, inter alia, provided that the said section shall not
apply in any case where the local authority having control of
any road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved
by the Governor in Council:

And whereas by subsection two of section one hundred
and seventeen of the Public Works Act, 1908, it is provided
that such approval may be either absolute or subject to
such conditions with respect to the building-line as the
Governor, by Order in Council, thinks fit to impose:

And whereas the Wellington City Council, the local autho-
rity having control of the portion of street described in the
Schedule hereto, has passed the following resolution—viz.,
“ The Wellington City Council, being the local authority having
the control of the streets in the City of Wellington, hereby
declares that the provisions of section one hundred and
seventeen of the Public Works Act, 1908, shall not apply to
the portion of Reuben Avenue in the said city which is less
than sixty-six feet in width; subject, however, to the con-
dition that no new building shall be erected with a frontage
in such street at a less distance than thirty-three feet from
the centre-line of the street”:

And whereas it is deemed expedient that such resolution
should be approved, subject to the condition hereinafter
mentioned:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Act,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby
approve of the said resolution, subject to the condition that
no building or part of a building shall at any time be
erected on either side of the said portion of street within a
distance of thirty-three feet from the centre-line of the said
portion of street.


SCHEDULE.

ALL that portion of Reuben Avenue (Brooklyn), in the
Wellington Land District, City of Wellington, adjoining Lots
or portions of Lots 103, 104, 105, 106, 107, 108, 109, 110,
115, and 116, D.P. 1004. As the said portion of street is
more particularly delineated on the plan marked P.W.D.
41122, deposited in the office of the Minister of Public Works
at Wellington, in the Wellington Provincial District, and
thereon coloured red.

Quarry and Auld Streets and Portion of Fergusson, Bowen,
and Alfred Streets, in the Borough of St. Kilda, exempted
from the Provisions of Section 117 of the Public Works Act,
1908.

thousand nine hundred and sixteen, pass the following resolu-
tion—viz., “Resolved that, pursuant to the provisions of
section one hundred and seventeen of the Public Works Act,
1908, the St. Kilda Borough Council, being the local authority
having control of Fergusson Street, Quarry Street, Bowen
Street, Alfred Street, and Auld Street, St. Kilda, hereby
declare that, subject to the approval of the Governor in
Council, the provisions of the said section one hundred and
seventeen shall not apply to the said Quarry Street and the
said Auld Street, and to those portions of Fergusson Street,
Bowen Street, and Alfred Street coloured red on the plan
hereunto annexed, and signed by the Town Clerk of the
Borough of St. Kilda by way of identification, showing
portion of streets in the Township of Musselburgh to be
exempted from widening, prepared by Mr. Nathaniel Paterson,
Licensed Surveyor, Dunedin; and that the common seal of
the Mayor, Councillors, and Burgesses of the Borough of
St. Kilda be attached to this resolution”:

And whereas it is deemed expedient that such resolution
should be approved:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by the above-in-part-recited Act, and acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the said
resolution.


SCHEDULE.

  1. ALL that street situated in the Otago Land District,
    Borough of St. Kilda, known as Quarry Street, situated
    between Fergusson and Bowen Streets.

  2. Also all that street situated in the said land district and
    borough, known as Auld Street, situated between Alfred
    Street and Victoria Road.

  3. Also all that portion of Fergusson Street, in the said
    land district and borough, adjoining Section 7, Township of
    Musselburgh.

  4. Also all that portion of Bowen Street, situated in the
    said land district and borough, adjoining Sections 7 and 6,
    Township of Musselburgh.

  5. Also all that portion of Alfred Street, situated in the
    said land district and borough, adjoining Section 11, Town-
    ship of Musselburgh.

As the said streets and portions of streets are more par-
ticularly delineated on the plan marked P.W.D. 41285,
deposited in the office of the Minister of Public Works at
Wellington, in the Wellington Provincial District, and thereon
coloured red.

Revoking Order in Council conferring Jurisdiction on Native
Land Court in respect of Pakuri Block.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this eleventh
day of December, 1916.

Present:

THE HONOURABLE A. L. HERDMAN PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the twenty-
seventh day of July, one thousand nine hundred
and fourteen, and issued under section one hundred and
three of the Native Land Act, 1909, the Native Land Court
was authorized to exercise the jurisdiction conferred upon it
by Part V of the said Act with respect to certain land known
as the Pakuri Block, comprising approximately one thousand
two hundred and six acres, and situated in the Auckland
Provincial District: And whereas application has not been
made to the said Court for the exercise of the jurisdiction so
conferred upon it, and it is expedient accordingly that the
said Order in Council be revoked:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority vested in him by the said Act or by
any other Act or authority enabling him in that behalf, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby revoke the said
Order in Council.
