Domain Board appointed to have Control of the Warea Domain.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this eighteenth day of December, 1916.

Present:

THE HONOURABLE J. ALLEN PRESIDING IN COUNCIL.

WHEREAS by section forty of the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to Part II of the said Act, control of such domain:

And whereas by an Order in Council made on the twenty-second day of November, one thousand nine hundred and nine, and published in the New Zealand Gazette of the twenty-fifth day of November, one thousand nine hundred and nine, a Domain Board was appointed to control the Warea Domain:

And whereas the period for which the said Board was appointed expired on the twenty-first day of November, one thousand nine hundred and sixteen:

And whereas it appears expedient to again appoint a Domain Board to control the domain:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

GEORGE JULIAN,
WILLIAM BLAND CLARKE,
PERCIVAL AUSTIN PUTT,
WILLIAM HENRY JULIAN, and
CHARLES STUART MUIR

to be the Warea Domain Board, having control of the land described in the Schedule hereto for the purposes of and subject to the provisions of the said Act; and doth hereby appoint Monday, the fifteenth day of January, one thousand nine hundred and seventeen, at seven o’clock p.m., as the time when, and the Warea Hall as the place where, the first meeting of the said Board shall be held.

SCHEDULE.

WAREA DOMAIN.

ALL that area in the Taranaki Land District, containing by admeasurement 18 acres 3 roods, more or less, being part of Section 16, Block IV, Cape Survey District. Bounded towards the east by Section 1, Block IX, 870·9 links, from the Waiweranui Stream to a public road; towards the south by a public road, 1535·9 links; towards the west by South Road, 1136·5 links; towards the north and again towards the west by the other part of Section 16, 190·6 and 296 links respectively; and again towards the north by the Waiweranui Stream to the place of commencement, and being all the land comprised in certificate of title, Taranaki, Vol. 2, folio 195.

Exchanging Portion of a Reserve in Block XII, Kaeo Survey District, Auckland Land District, for other Land.

THE HONOURABLE J. ALLEN PRESIDING IN COUNCIL.

WHEREAS the land described in the First Schedule hereto forms portion of a reserve heretofore duly set apart for a cemetery, being a reserve within Class I of the Second Schedule to the Public Reserves and Domains Act, 1908 (hereinafter referred to as “the said Act”): And whereas by section four of the said Act the Governor is authorized, inter alia, to exchange any such reserve for other land of equal value, to be dedicated to the same or one or more of the purposes comprised in the said Class I, and to define the purpose to which such reserve or such land acquired in exchange shall be dedicated: And whereas, in the opinion of the Governor, it is expedient to exchange the said portion of the cemetery reserve for other land of equal value, described in the Second Schedule hereto, to be dedicated as hereinafter provided:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by section four of the said Act, doth hereby declare that the portion of the cemetery reserve described in the First Schedule hereto is hereby exchanged for the Crown land described in the Second Schedule hereto, which, in the opinion of the Governor, is of equal value; and doth also declare that the land described in the said First Schedule becomes and is Crown land freed from all previous reservation and subject to the provisions of the Land Act, 1908; and that the land described in the said Second Schedule is hereby reserved for cemetery purposes, being one of the purposes comprised in the said Class I.

FIRST SCHEDULE.

DESCRIPTION OF PORTION OF RESERVE EXCHANGED.

ALL that area in the Auckland Land District, containing by admeasurement 3 acres 0 roods 17 perches, more or less, being part Section 15, Block XII, Kaeo Survey District (cemetery reserve), and bounded, commencing at the north-east corner of said Section 15, towards the north-east by a public road, 109·6 links; towards the south-east by other part of said Section 15, 710·3 links; towards the south by a right line due west, 88·9 links; towards the south-west by a right line bearing 321° 7′, 642·7 links; and towards the north by a right line due east, 1000 links, to the point of commencement: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 2/313, deposited in the Head Office, Department of Lands and Survey at Wellington, and thereon edged red.

SECOND SCHEDULE.

DESCRIPTION OF LAND OBTAINED IN EXCHANGE THEREFOR.

ALL that area in the Auckland Land District, containing by admeasurement 3 acres 0 roods 15 perches, more or less, being Section 33, Block XII, Kaeo Survey District. Bounded towards the north by Section 15, Block XII, Kaeo Survey District, 911·1 links; towards the north-east by a public road, 75·1 links; towards the south-east and south-west by Section 28, Block XII aforesaid, 838 and 607·2 links respectively; and towards the north-west by Crown land, 94·5 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 2/313A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Licensing Robert P. Gibbons (Limited) to use and occupy a Part of the Foreshore and Land below Low-water Mark of Kaihu Creek, Kaipara Harbour, as a Site for a Timber-boom.

At the Government Buildings at Wellington, this eleventh day of December, 1916.

THE HONOURABLE A. L. HERDMAN PRESIDING IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, the Robert P. Gibbons (Limited), of Thames, Auckland (hereinafter called “the company”), has applied to the Governor in Council for a license under the Harbours Act, 1908 (hereinafter called “the said Act”), to occupy a part of the foreshore and land below low-water mark of Kaihu Creek, Kaipara Harbour, as a site for a timber-boom, and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited a plan in the office of the Marine Department at Wellington (marked M.D. 4698), showing the place where it is intended to construct such timber-boom, the area of foreshore and land below low-water mark intended to be occupied for such purpose, and the manner in which it is proposed to carry out the work:

And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation, and the said plan has, prior to the making of this Order in Council, been approved by the Governor in Council:
