and evidence for the use of the Judges of the Court of Appeal. The Registrar shall thereupon set down the appeal by entering the same in the list of appeals, and it shall come on to be heard according to its order in such list unless the Court of Appeal shall otherwise direct.

(b.) No appeal shall be deemed to be set down under this rule unless the printed copies are filed and left with the Registrar on or before the last day for setting down the appeal.

(c.) Except in the case of appeals under the Crimes Act, 1908, leave to set down otherwise than in accordance with this rule will only be granted upon good cause shown and upon such terms as the Court shall think proper.

(d.) In the event of non-compliance with this rule the Court of Appeal may, on the application of the respondent, make an order declaring that the appeal, or the notice of appeal, has been abandoned, or adjourning the appeal, and may in either case allow costs to the respondent.

(e.) The provisions of this rule shall apply, mutatis mutandis, to every case removed into the Court of Appeal under section 64 of the said Act.

Appointing a Member of Assessment Court under the Valuation of Land Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this twentieth day of November, 1916.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the power and authority vested in him by the Valuation of Land Act, 1908, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint the person mentioned in the Schedule hereto to be a member of the Assessment Court for the districts set opposite his name.

Declaring Portion of Hangaroa-Waikaremoana Road, in the Wairoa County, to be a County Road.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House at Wellington, this twentieth day of November, 1916.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.


SCHEDULE.

ALL that portion of Hangaroa-Waikaremoana Road, in the Hawke’s Bay Land District, Wairoa County, commencing at its junction with the Bushy Knoll Road, in Block V, Hangaroa Survey District, and extending thence generally in a south-westerly direction, adjoining or passing through Section 1, Block V, Hangaroa Survey District, Section 2, Block VIII, Tuahu Survey District, and Small Grazing-run 85, Blocks VIII and VII, Tuahu Survey District, and terminating at its junction with the Ruakituri Valley Road; being a distance of eight miles, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 41267, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

ALL that portion of road in the Clifton County, Taranaki Land District, known as Kiwi Road, commencing at a point three miles south of the junction with Tongaporutu-Mangaroa Road, and running in a south-easterly direction generally, adjoining or passing through Section 5, Block XIII, Waro Survey District, to its junction with Tooi Road; being a distance of 38·40 chains, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 41213, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Declaring Portion of Mangatiti East Road, in the Waimarino County, to be a County Road.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

ALL that portion of road, in the Wellington Land District, Waimarino County, known as Mangatiti East Road, commencing at its junction with the Murumuru Road, and proceeding thence generally in a westerly direction along part frontage of Section 12, Block XII, Whirinaki Survey District, and terminating at a point sixty-five chains from the said junction; being a distance of sixty-five chains, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 41283, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.
