powers and authorities conferred on him by the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said regulation of the thirtieth day of September, one thousand nine hundred and seven, and doth hereby make the following regulation in lieu thereof.

REGULATION.

No person shall take or catch more than twenty trout or more than fifty-six pounds weight of trout in any one day.

Authorizing Sale of Land in the Borough of Onehunga under the Public Works Act, 1908.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House at Wellington, this thirtieth day of October, 1916.

Present:

His Excellency the Governor in Council.

WHEREAS by the thirtieth section of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work the Governor may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:

And whereas a memorial has been laid before the Governor by the Onehunga Borough Council (hereinafter called “the said Council”), accompanied by a map, setting forth that certain land was acquired for the purposes of waterworks:

And whereas the land as described in the Schedule hereto is not now required by the said Council for the purposes aforesaid, and the said Council desires to sell the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the land described in the Schedule hereto to be dealt with and sold in the manner prescribed by and subject to the conditions of the thirtieth and following sections of the said Act.

SCHEDULE.

APPROXIMATE area of the piece of land authorized to be sold: 2 acres 3 roods 38·03 perches.

Being Lots 7 to 15, D.P. 8471, being part of subdivision of Small Farm Lot 24, Town of Onehunga.

Situated in the Borough of Onehunga, Blocks I and V, Otahuhu Survey District.

In the Land District of Auckland; as the same is more particularly delineated on the plan marked P.W.D. 40850, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon edged red (S.O. 19173).

Consenting to the Raising of a Loan of £1,300 proposed to be raised by the Whangarei Borough Council to complete the Construction of the Necessary Plant to supply Electricity within and without the Borough of Whangarei.

At the Government House at Wellington, this thirtieth day of October, 1916.

Present:

His Excellency the Governor in Council.

WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board, during the present war with Germany, to borrow or contract to borrow (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf), whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor in Council:

And whereas application has been made for the consent of the Governor in Council to enable the Whangarei Borough Council to borrow the above-mentioned loan:

And whereas it is expedient that the precedent consent of the Governor in Council should issue:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing of the loan above mentioned, provided that the rate of interest at which the loan is to be raised shall not produce to the lender a return exceeding five and one-quarter pounds per centum per annum. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor in Council to the raising of the loan hereby authorized.

WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board during the present war with Germany to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf) whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor in Council:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing of the loans herein-after mentioned by the local authorities set out in the Schedule hereto; provided that the rate of interest at which the loans or any of them are to be raised shall in no case produce to the lender a return exceeding five and one-quarter pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor in Council to the raising of the loans hereby authorized.
