Revoking Part of a Proclamation taking Land for a Portion of the East Coast Main Trunk Railway (Portion of Athenree Section), and for a Road-diversion in Connection therewith.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that the land, or any part thereof, is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation, or the making or gazetting thereof, the Governor may, by a subsequent Proclamation gazetted, revoke the former Proclamation, either wholly or so far as he thinks necessary :

And whereas it is found that part of the land taken for a portion of the East Coast Main Trunk Railway (portion of Athenree Section), and for a road-diversion in connection therewith, by a Proclamation made under the Public Works Act, 1908, dated the twenty-ninth day of April, one thousand nine hundred and sixteen (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 54, page 1610, of the fourth day of the following month, is incorrectly described :

And whereas compensation in respect of the taking of the said land has not been paid or awarded :

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects that portion of land, containing 1 rood 5·85 perches, described in the said Proclamation as portion of Section 152A, Waihi Township, Blocks XV and XVI, Ohinemuri Survey District, Borough of Waihi.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this twenty-fifth day of October, in the year of our Lord one thousand nine hundred and sixteen.

APPROXIMATE area of the piece of land not required: 1 acre 0 roods 17 perches.

Portion of Lot 1 of Fairburn’s Grant, Pakuranga Parish (D.P. 2167), Block II, Otahuhu Survey District (S.O. 17913).

In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 36672, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured edged red.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this twenty-fifth day of October, in the year of our Lord one thousand nine hundred and sixteen.

Stopping a Government Road in Block VI, Kawakawa Survey District.

A PROCLAMATION.

WHEREAS by paragraph (c) of section one hundred and thirty-three of the Public Works Act, 1908, it is enacted that the Governor may, by Proclamation publicly notified, stop or alter the course of any Government road or any part thereof :

And whereas the Government road described in the Schedule hereto is no longer required for the purpose of a road :

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling me in this behalf, do hereby proclaim as stopped the road described in the Schedule hereto.

SCHEDULE.

APPROXIMATE areas of the pieces of road hereby stopped:—

A. R. P. Adjoining or passing through
0 1 30 O.L.C. 4 and Section 5 (C.L.).

Situated in Block VI, Kawakawa Survey District (S.O. 19154).

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that any land or any part thereof is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation, the Governor may, by a subsequent Proclamation gazetted, revoke the former Proclamation, either wholly or in so far as he thinks necessary :

And whereas compensation in respect to the taking of the said portion of land has not been paid or awarded :

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects that piece of land which is described in the Schedule hereto.
