Portion of the Southern Side of Hoon Hay Road, in the Halswell County, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.


LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House at Wellington, this eighteenth day of September, 1916.

Present:

His Excellency the Governor in Council.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Halswell County Council, the local authority having control of the portion of road described in the Schedule hereto, hereinafter referred to as the said portion of road, did, on the eighteenth day of April, one thousand nine hundred and sixteen, pass the following resolution—viz., “That the Halswell County Council, being the local authority having control of the public road called “Hoon Hay Road,” in the Halswell County, hereby resolves and declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, and of the Acts amending the same, shall not apply to the south side of that portion of the said road having a width of 80 links and a length of 3362·7 links, and fronting on Rural Section 338B and part of Rural Section 6360, and coloured pink in the plan produced to this meeting of the Council”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the southern side of the said portion of road, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building or part of a building shall be erected at any time on the southern side of the said portion of road within a distance of thirty-three feet of the centre-line of the said portion of road.


SCHEDULE.

ALL that portion of Hoon Hay Road, in the Halswell County, Canterbury Land District, fronting on Rural Section 338B and part Rural Section 6360, Block XIV, Christchurch Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 40052, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured pink.

Lands temporarily reserved.

LIVERPOOL, Governor.

WHEREAS by the three-hundred-and-twenty-first section of the Land Act, 1908, it is enacted that the Governor may from time to time, either by general or particular description, and whether the same has been surveyed or not, reserve from sale temporarily, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby temporarily reserve from sale the lands described in the Schedule hereunder written, for the purposes in the said Schedule specified at the end of the respective descriptions of the lands so intended to be temporarily reserved.


SCHEDULE.

AUCKLAND LAND DISTRICT.

ALL that area in the Auckland Land District, being Section 122, Block IX, Aroha Survey District, containing by admeasurement 20 acres, more or less. Bounded towards the north-west and north-east by Crown land, 2071·3 and 859 links respectively; towards the south-east generally by the Te Aroha Water-supply Reserve, 211·7, 108, 121, 1061, 416, 316, 527, and 32·7 links; towards the south-west by Sections 82, 81, 80, 79, 78, and 77, Goldfield Township of Te Aroha, 587·1 links; again towards the north-west by Bridge Street, 450 links; and again towards the south-west by the abutment of Bridge Street aforesaid and by Crown land, 414 links; be all the aforesaid linkages more or less. As the same is delineated on plan marked L. and S. 6/5/32, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (Auckland Plan No. 19042.) For quarry purposes.

HAWKE’S BAY LAND DISTRICT.

All that area in the Hawke’s Bay Land District, containing by admeasurement 28 perches, more or less, being Section No. 1, Block XII, Puketapu Survey District. Bounded towards the south-east by Lot 1, D.P. 1906, 272·3 and 140·6 links; and towards the north-west by public road, 352·5 links. For a resting-place for travelling stock.

Also all that area in the Hawke’s Bay Land District, containing by admeasurement 3 roods 1·3 perches, more or less, being Section 2, Block XII, Puketapu Survey District. Bounded towards the north-east by part Lot 2, D.P. 1438, 763 links; towards the south-east by public road, 100·4 links; towards the south-west by other part Lot 2, D.P. 1438, 753·9 links; and towards the north-west by public road, 100 links. For a resting-place for travelling stock.

Be all the aforesaid linkages more or less; as the same are delineated on the plan marked L. and S. 6/1/112, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

As witness the hand of His Excellency the Governor, this eighteenth day of September, one thousand nine hundred and sixteen.

Notifying Lands in Southland Land District for Sale by Public Auction.

LIVERPOOL, Governor.

IN pursuance of the powers and authorities conferred upon me by the one-hundred-and-twenty-sixth section of the Land Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby appoint Tuesday, the twenty-first day of November, one thousand nine hundred and sixteen, as the time at which the lands described in the Schedule hereto shall be sold by public auction; and I do hereby fix the prices at which the said lands shall be sold as those mentioned in the said Schedule hereto.


SCHEDULE.

SOUTHLAND LAND DISTRICT.—RURAL LAND.

Southland County.—Slopedown Survey District.

Section 3A, Block I: Area, 88 acres 1 rood 27 perches; upset price, £265.

Weighted with £8 5s., valuation for improvements (road fence).

Level land in native state; 5 to 7 acres peat, balance intersected by swampy creeks, but capable of being drained and cultivated. Situated eight miles and a half from Clinton by good metal road.

Wallace County.—Waiau Survey District.

Section 110, Block IX: Area, 183 acres; upset price, £100.

Weighted with £15, valuation for improvements (fencing).

Greater part of section is wet and of poor peaty nature. There are some patches of rough grazing. Situated about two miles and a half from Eastern Bush.

As witness the hand of His Excellency the Governor, this fifteenth day of September, one thousand nine hundred and sixteen.
