Validating the Public Notifications in connection with Proceedings taken for the Raising of a Loan of £800 for reforming and metalling a Portion of the Mangatainoka North Road, proposed to be raised by the Council of the County of Pahiatua.

ORDER IN COUNCIL.
At the Government House at Wellington, this twenty-sixth day of July, 1915.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Pahiatua County Council lately proposed to raise a loan of eight hundred pounds under the Local Bodies' Loans Act, 1913, for the purpose of reforming and metalling a portion of the Mangatainoka North Road :

And whereas the public notifications of the special order authorizing the raising of the above loan, although published four times, were not published once in each of the four weeks immediately preceding the day on which the subsequent meeting was to be held, inasmuch as no public notice was given in the third week immediately preceding the date of confirmation of the special order, as required by the provisions of section ninety-seven of the Counties Act, 1908 :

And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the said proceedings :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies' Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said proceedings, and doth hereby order and declare that the said public notifications of the special order authorizing the loan shall be valid to all intents and purposes as though the same had been published in the proper manner; and that the proceedings in connection with the said loan shall not be called into question by reason only of the irregularity aforesaid.

Approving the Canterbury Poor of Great Britain, Ireland, and Belgium Relief Fund under the War Contributions Validation Act, 1914 (No. 2).

LIVERPOOL, Governor.

WHEREAS by section two of the War Contributions Validation Act, 1914 (No. 2), (hereinafter referred to as “the said Act”), it is enacted as follows :—

Contributions, whether in money or kind, may be made by any local authority or body of persons, whether corporate or unincorporate, other than private trustees under a settlement or will,—

(a.) For the relief of distress occasioned by the war in which His Majesty is at present engaged, whether such distress exists in New Zealand or elsewhere in the British Dominions, or in any country allied to His Majesty ;

(b.) For any patriotic objects approved for the purposes of this Act by the Governor :

Provided that every such contribution is paid either—

(i.) Into a public fund established by the Government, or by any local authority, for the purposes of such relief of distress, or patriotic objects ; or

(ii.) Into a fund established by persons other than the Government or a local authority, where such fund and the conditions of control and expenditure thereof are approved for the purposes of this Act by the Governor :

And whereas certain persons in the Provincial District of Canterbury have formed themselves into a society known as the Poor of Great Britain, Ireland, and Belgium Relief Fund (Incorporated), for the following purposes, namely :—

(a.) To take over the whole of the funds in the hands of a committee styled “The Poor of Great Britain, Ireland, and Belgium Relief Fund Committee,” and which committee was recently formed for the purpose of raising money for the relief of the poor of Great Britain, Ireland, and Belgium during the war in which His Majesty is at present engaged, and during the continuance of the distress occasioned thereby ;

(b.) To establish, organize, manage, and control a fund for the purpose of the relief of the poor of Great Britain, Ireland, Belgium, and of any of His Majesty’s allies in the present war ;

(c.) To apply for the approval of His Excellency the Governor of New Zealand of such fund for the purposes and under the provisions of the War Contributions Validation Act, 1914 (No. 2) ;

(d.) To accept subscriptions and donations in money and kind, and whether of real or personal estate, and devises and bequests for the purposes aforesaid ;

(e.) To promote or join with any other public or private body, association, persons, or person in promoting any scheme, function, or method for raising money or obtaining gifts in kind for the purposes aforesaid, and to give the patronage and approval of the society to any public or private scheme for the same purpose ;

(f.) To sell and dispose of any real and personal estate coming into the possession of the society, or to mortgage, let, or manage the same ;

(g.) To charter any ship or enter into any contract of affreightment for the carriage of any goods to Europe or elsewhere ;

(h.) To pay over or donate moneys to any fund established in Great Britain, Ireland, Belgium, or elsewhere for the purpose aforesaid, or to any Minister of State for the like purposes, and to consign goods or gifts in kind, food, or other produce to any officer, official, or person to be used for the purpose aforesaid ;

(i.) To purchase any goods or produce and to expend any moneys in the hands of the society in so doing ;

(j.) To do all such other lawful things as are incidental or conducive to the attainment of any of the above objects :

And whereas the said society has established a fund for the promotion of the objects hereinbefore expressed, and has submitted the said fund and the conditions of control and the expenditure thereof for approval, as required by the hereinbefore-quoted provisions of the said Act :

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby approve for the purposes of the said Act—

(1.) The fund hereinbefore referred to, established by the Poor of Great Britain, Ireland, and Belgium Relief Fund (Incorporated) ; and

(2.) The conditions of control and expenditure of the said fund, as set out in the rules adopted by the said society on the thirteenth day of January, one thousand nine hundred and fifteen.

As witness the hand of His Excellency the Governor, this twenty-seventh day of July, one thousand nine hundred and fifteen.

Declaring a Road-line through Land in the Lansdown Settlement, Canterbury Land District, to be closed.

LIVERPOOL, Governor.

WHEREAS a report has been received from the Surveyor-General from which it appears that the road described in the Schedule hereto is unformed and unused, and that the said road intersects land acquired under the Land for Settlements Act, 1908, and is not suitable to the subdivision of such land :

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of section eighty of the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do by this notice hereby close the road hereinafter described ; and I do hereby declare that the said road shall thereupon become subject to the said Act.

SCHEDULE.

LANSOWN SETTLEMENT.

APPROXIMATE area of the piece of road closed : 8 acres 2 roods 3 perches.

Passing through Sections 16666 and 16681, Block V, Waimate Survey District.

In the Canterbury Land District; as the same is more particularly delineated on the plan marked L. and S. 19456/50, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured green.

As witness the hand of His Excellency the Governor, this twenty-first day of July, one thousand nine hundred and fifteen.
