Special Order made by the Mount Wellington Road Board making By-laws.

THE following special order, made by the Mount Wellington Road Board, is published in accordance with the provisions of the Road Boards Act, 1908.

In pursuance and exercise of the powers vested in it by the Road Boards Act, 1908, and its amendments, the Public Works Act, 1908, and its amendments, and all or any other statutes it hereunto enabling, the Road Board of the Mount Wellington Road District doth hereby by special order ordain and enact as follows.

HEAVY TRAFFIC BY-LAW.

  1. The by-law relating to heavy traffic passed by the said Board on the 15th day of December, 1914, and confirmed on the 2nd day of February, 1915, and published in the New Zealand Gazette on the 18th day of February, 1915, at page 612, is (from and immediately after the date on which these by-laws shall come into operation) repealed, but shall, notwithstanding, remain in full force so far only as relates to any offence committed, penalty incurred, prosecution or proceeding commenced, or license issued under or against any of the provisions thereof before the coming into force of these by-laws, and in substitution and lieu thereof the following is enacted.

  2. In these by-laws, if not inconsistent with the context,—

(a.) “Heavy traffic” shall mean the transport of any vehicle, engine, or machine which shall itself, or together with any thing or things being transported thereon, weigh more than one and a half tons avoirdupois to each pair of wheels.

(b.) “The owner” of any vehicle shall include a bailee or hirer entitled to the possession and use or profit thereof.

  1. The owner of any vehicle engaged in heavy traffic upon any of the roads within the Mount Wellington Road District shall, before using such vehicle upon any such road or roads, apply to the Mount Wellington Road Board for a license therefor, and shall pay for such license an annual fee as follows:—

(a.) In respect of any horse-drawn two-wheeled vehicle having tires of a less width than 4 inches .. .. .. £ s. d. 10 0 0

(b.) In respect of any horse-drawn four-wheeled vehicle .. .. .. 5 0 0

(c.) In respect of any mechanically propelled vehicle whose carrying-capacity exceeds 3 tons .. .. .. 10 0 0

(d.) In respect of any other horse-drawn or mechanically propelled vehicle .. 5 0 0

Provided, nevertheless, that the Board, at its discretion, and on application by the owner or driver of any vehicle engaged in carting earth, stone, or scoria-ash, may permit the owner or driver of such a vehicle to use such vehicle for the purpose of carting earth, stone, or scoria-ash upon any of the roads in the district without having paid such license fee, upon payment to the said Board of the following charges:—

For every load carried on any one day upon or over any such road: One shilling.

If more than three loads are carried in any one vehicle in any one day upon or over any such road, then for that day: Three shillings.

  1. Any person who at any time after the coming into operation of this by-law shall use any vehicle for heavy traffic within the Mount Wellington Road District without having first paid such license fee for such vehicle, and obtained a license which shall then be in force, or without having the permission provided for in the preceding clause, or who shall do or cause to be done or be concerned in doing anything contrary to any of these by-laws, or who shall omit to do anything required to be done by him by any such provision, shall be deemed to have committed a breach of these by-laws, and on conviction thereof shall be liable for each offence to a penalty not exceeding five pounds.

  2. Any constable, or officer of the Board duly authorized in that behalf, may stop and detain any vehicle which in his opinion infringes any of these by-laws, and inspect and examine the weight of such vehicle and the contents thereof, and the driver or person for the time being in charge of the vehicle shall permit such inspection, examination, and weighing to be made accordingly, and shall, if so required by any such constable or officer, take such vehicle (together with the contents thereof) to the nearest public weighbridge, and then and there weigh the same, or permit and allow the same to be weighed thereon; and no person shall obstruct any such officer or constable in or about the making of such inspection, examination, or weighing.

  3. Application for licenses under clause 3 hereof shall be made in writing to the Clerk of the Board. Such licenses shall expire twelve calendar months from the date of the issue thereof.

  4. The Clerk of the Board shall keep a register of all licenses issued under this by-law. Such register shall be open to public inspection without fee.

  5. Every license issued under section 3 of these by-laws shall be numbered, and the owner of the vehicle shall cause the number of such license (when issued by the Board) and the letters “M.W.” to be legibly painted or marked on the off side of such vehicle.

The common seal of the body corporate the Inhabitants of the Mount Wellington Road District was affixed to the foregoing by-laws in pursuance of a resolution of the said Board passed at a meeting of the Board held on Thursday, the 24th day of June, 1915, in the presence of—

I hereby certify that the foregoing by-laws were duly passed by the Mount Wellington Road Board by special order, the resolution in respect of which was passed at a special meeting of the said Board convened for that purpose on the 20th day of May, 1915, and confirmed at a subsequent meeting of the Board held on the 24th day of June, 1915; and that all public notifications, notices, deposits, and other requirements of the Road Boards Act, 1908, and its amendments, the Public Works Act, 1908, and its amendments, have been duly complied with in respect of such special order.
