APPLICATION having been made to me to register a surrender of Lease No. 3775, of part of Section 43, Block IX, Town of Dunedin—RODERICK MCKENZIE, of Dunedin, Hotelkeeper, Lessee—and a declaration having been lodged of the loss of the outstanding duplicate of the said lease, I hereby give notice that I intend to register the said surrender of lease, and to dispense with the production of the said outstanding duplicate, as empowered by section 40 of the Land Transfer Act, 1908, unless a caveat be lodged in this office forbidding the same within fourteen days from the date of the publication hereof.

In the matter of the Legislature Act, 1908; and in the matter of the Georgetti Trust Estate Act, 1915, being a proposed Private Estate Bill intituled “An Act to vary and declare the Interests taken by the Children and Grandchildren of one Augustin Georgetti under the Last Will of the said Augustin Georgetti, and to authorize the Sale and Disposal of the Estate of the said Augustin Georgetti.”
NOTICE is hereby given that JAMES GEORGETTI, of Mangaweka, in the Provincial District of Wellington, Hotelkeeper, CHARLES GEORGETTI, of Wanganui, in the said Provincial District, Farmer, JOHN GEORGETTI, of Wanganui aforesaid, Farmer, and ISABEL ANN MISSEN, of Wanganui aforesaid, Widow, intend within one month after publication of this notice to apply by petition to the General Assembly of New Zealand at its next session for the passing of the above-mentioned proposed Private Estate Bill.
The objects to be effected by the said Private Estate Act are to vary and declare the interests taken by the children of the said Augustin Georgetti and the grandchildren of the said Augustin Georgetti under the will of the said Augustin Georgetti, and to authorize the sale and disposal of the real and personal estate of the testator, such declaration being to the following effect :—
(1.) That the trustees for the time being of the will of the said Augustin Georgetti, deceased, may and they are thereby expressly authorized to sell and dispose of the whole of the real and personal estate of the said Augustin Georgetti affected by the will of the said Augustin Georgetti of the 12th day of February, 1895.
(2.) Any sale of the said estate to be by public auction. The property to be sold in one or more lot or lots.
(3.) The proceeds of such sale to be received by the trustees and applied in manner following :—
(a.) In payment of the costs, charges, and expenses of and incidental to the promoting and passing of the Act and the realization and disposal of the real and personal estate of the said Augustin Georgetti.
(b.) In payment to the children of the said Augustin Georgetti in equal shares of one-half of the balance of the proceeds of such realization.
(c.) The trustees to stand possessed of the other half of the balance of such realization upon the trusts following,—
(d.) To invest the same, at a rate of interest not less than £5 per centum per annum, upon mortgage of real estate in New Zealand (including the real estate of the said Augustin Georgetti) for a term not exceeding five (5) years.
(e.) To pay the annual income arising from such investments to the children of the said Augustin Georgetti during their lives in equal shares.
(f.) In the event of any of the children of the said Augustin Georgetti dying leaving issue, to pay to or apply for the maintenance, education, and support of such issue the share in such income his, her, or their parent would have taken if alive, and if more than one, then in equal shares.
(g.) In the event of any of the said children of the said Augustin Georgetti dying without leaving issue, to pay the share in such income of such child so dying to and among his or her surviving brothers or sisters in equal shares.
(h.) To stand possessed of the capital of such investments upon trust for all the grandchildren of the said Augustin Georgetti, whether born before or after the passing of this Act, who either before or after the death of his, her, or their parent attain the age of twenty-one years, and if more than one, in equal shares.
(4.) The will of the said Augustin Georgetti to be read and construed and be deemed to take effect in accordance with the provisions herein set out.
