Also all that portion of road, in the said land district and county, commencing at its junction with Edwards Road, and proceeding thence in a southerly direction, adjoining the eastern boundaries of Sections 1 of 38 and 2 of 28, Block VII, Motueka Survey District, and terminating at the south-eastern corner of the said Section 2 of 28.

As the said portions of roads are more particularly delineated on the plan marked P.W.D. 31969, and deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

At the Government Buildings at Wellington, this twenty-fourth day of May, 1915.

BY virtue of the powers and authorities conferred upon me by the sixth section of the Tourist and Health Resorts Control Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the Te Ana Domain, in the Southland Land District, described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of the Tourist and Health Resorts Control Act, 1908; and such reserve shall hereafter be managed, administered, and dealt with in manner directed by the said Act.


SCHEDULE.

TE ANA DOMAIN.

ALL that area in the Southland Land District, containing by admeasurement 2 acres 0 roods 29 perches, more or less, being Section 48, Block VII, Waiau Survey District (Merrivale Settlement). Bounded towards the north-east by Section 5, Block VII, Waiau Survey District, 201·3 links; thence towards the south-east by a public road 2 chains wide, 678·1 links; and thence towards the south-west and north-west by Section 4A of said block and survey district, 545 and 584·6 links respectively: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. I/405, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

License authorizing John Barnett, Settler, Leeston, to use Water for the Purpose of generating Electricity, and to erect Electric Lines across Bluett’s Road, Leeston, in the Canterbury Provincial District.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-fourth day of May, 1915.

WHEREAS by section five of the Public Works Amendment Act, 1908, it is enacted that the Governor may from time to time by Order in Council grant to any person or body corporate a license to use water from any fall, river, stream, or other source for the purpose of generating electricity for electric light, mechanical power, or other uses, and to exercise in respect of that purpose any of the powers and authorities specified in that behalf in the said section: And whereas it is further provided by the said section that any such license may confer upon the licensee a right at any time or times during the continuance of the license (but subject to such conditions and restrictions as are expressed in the license) to enter upon any road, railway, or other land, whether vested in or occupied by the Crown or any other person or body corporate, and there to construct, erect, lay down, maintain, renew, or repair all such cables, wires, and other things as are required for the transmission of electricity between the fall, river, stream, or other source aforesaid and any place to which the licensee is authorized to transmit electricity in pursuance of the license :

And whereas John Barnett, of Deep Stream Farm, Leeston (who with his successors, executors, administrators, and assigns is hereinafter referred to as “the licensee”), has applied for a license under the said section to take and use water from the water-race on the north side of Dunsandel Road and adjacent to Rural Section 5206, Block I, Southbridge Survey District, in the Provincial District of Canterbury (hereinafter referred to as “the said race”), for the purpose of generating electricity as aforesaid, and it is expedient to issue such license accordingly :

Now, therefore, in pursuance and exercise of the powers conferred upon him as aforesaid, and of the powers conferred by section two of the Public Works Amendment Act, 1911, and of all other powers enabling him in that behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to the licensee, subject to the terms and conditions hereinafter set forth, a license to take and use from the said race, for the purposes hereinafter set forth, a stream of water (hereinafter referred to as “the said water”) not exceeding one cubic foot per second at any one time, and also to erect and maintain across Bluett’s Road as indicated on the plan marked P.W.D. 37322, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, electric lines (hereinafter referred to as “the said electric lines”) for lighting, heating, and power purposes as hereinafter described.


TERMS AND CONDITIONS OF LICENSE.

In this license—

“Earthed” means connected to the general mass of earth in such manner as to ensure at all times an immediate and safe discharge to earth of electric energy without danger.

“Electric line” means any wire, wires, conductor, or other means used for conveying, transmitting, or distributing electricity for power, lighting, or heating purposes; and includes any instrument, insulator, casing, tubing, pipe-covering, or post enclosing or supporting an electric line or anything connected therewith.

“Inspecting Engineer” means and includes any Inspecting Engineer appointed by the Minister to inspect works to be constructed or maintained by virtue of electric-line licenses, or any water-power licenses, or any combined water-power and electric-line licenses, issued under the Public Works Act, 1908, and any or all of its amendments, or under any one or more of such amendments only, or any Act or Acts passed in amendment thereof or substitution therefor.

“Minister” means the Minister of Public Works.

“Pressure” means difference of electric potential between any two conductors through which supply of energy is given, or between any part of either conductor and the earth.

“Public Works Engineer” means the engineer in charge of the Public Works district in which the area of supply is situated.

“Telegraph” includes telephone.

“Telegraph line” has the same meaning as “electric line” in the Post and Telegraph Act, 1908; and also includes all telegraph, telephone, and electric signalling wires belonging to the Government Railways Department.

  1. UTILIZATION OF THE WATER.

The said water shall be used solely for the purpose of generating electricity, and shall be returned to Birdlings Brook at or near the power-house. Nothing in this license shall affect the liability of the licensee in respect to the riparian rights of the owner of any property affected by the diversion of the said water from the said race to Birdlings Brook.

  1. LOCATION OF HEADWORKS.

The said water shall be taken from the said race at the headworks, situated near the junction of Dunsandel main road with Hills Road, in Section 5206, Block I, Southbridge Survey District, at a point indicated on the plan marked P.W.D. 37322 hereinbefore referred to.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized to construct, maintain, and use the following works for the purposes of this license ;
