Domain Board appointed to have Control of the Otaki Domain.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this third day of May, 1915.

Present:

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred by the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke an Order in Council, dated the eighteenth day of October, one thousand nine hundred and nine, and published in the Gazette of the twenty-first day of October, one thousand nine hundred and nine, appointing a Domain Board to have control of the Otaki Domain, and doth hereby appoint

THE OTAKI TOWN BOARD

to be the Otaki Domain Board, having control of the land described in the Schedule hereto for the purposes of and subject to the provisions of Part II of the said Act; and doth hereby appoint Thursday, the third day of June, one thousand nine hundred and fifteen, at two o’clock p.m., as the time when, and the Town Board Office, Otaki, as the place where, the first meeting of the said Board shall be held.

SCHEDULE.

OTAKI DOMAIN.

ALL that area in the Wellington Land District, containing by admeasurement 6 acres 0 roods 17 perches, more or less, being part of Haruatai No. 11 Block, situate in Block IX, Waitohu Survey District. Bounded towards the north-west by the Makuratawhiti No. 8A and Haruatai No. 15A Blocks, towards the north-east by part of the Haruatai No. 11 Block, towards the south-east by a public road, and towards the south-west by part of the Haruatai No. 11 Block; as the same is delineated on the plan marked L. 1231, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Disley Street, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

At the Government Buildings at Wellington, this third day of May, 1915.

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or to any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor in Council thinks fit to impose:

And whereas the Wellington City Council, the local authority having control of the street described in the Schedule hereto, did, by resolution, declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE.

ALL that street in the Wellington Land District, City of Wellington, known as Disley Street, commencing at the most westerly corner of Allotment 8 of Section 10, Ohiro District, and proceeding thence in a north-easterly and then south-easterly direction generally adjoining Allotments 8 to 22 and 25 of Section 10, Ohiro District, and terminating at its junction with Hangcliff Street; as the said street is more particularly delineated on the plan marked P.W.D. 37658, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

Locking Street, in the City of Nelson, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.
