A PROCLAMATION.

IN pursuance and exercise of the powers conferred by section eleven of the Land Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby, with the consents of the owner of the land described in the First Schedule hereto, and of the Le Bons Bay Road Board, being the local authority in whose district the said land is situated, proclaim as a road the land in Okains Survey District described in the First Schedule hereto; and also do hereby, with the like consents as aforesaid, proclaim as closed the road described in the Second Schedule hereto, which is not required by reason of the road described in the First Schedule hereto.


FIRST SCHEDULE.
LAND PROCLAIMED AS A ROAD.

APPROXIMATE area of the piece of land proclaimed as a road: 1 acre 1 rood 27 perches.
Portion of R.S. 540.
Coloured on plan: Pink.

SECOND SCHEDULE.
ROAD CLOSED.

APPROXIMATE area of the piece of road closed: 3 roods 12 perches.
Adjoining or passing through Section 12656.
Coloured on plan: Green.

All situated in Block VI, Okains Survey District (Canterbury R.D.).

All in the Canterbury Land District; as the same are more particularly delineated on the plan marked P.W.D. 37425, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured as above mentioned.

Declaring Ohauiti Settlement Road, in the Tauranga County, to be a County Road.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-sixth day of April, 1915.

Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.


SCHEDULE.

ALL that road in the Auckland Land District, Tauranga County, known as Ohauiti Settlement Road, commencing at its junction with the main Ohauiti Road, and proceeding thence in a southerly direction generally adjoining or passing through Sections 9, Blocks IV and III, 18, 19, 20, Block III, 21, Blocks III and IV, 22, Blocks III, IV, VII, and VIII, 23, 24, Blocks VII and VIII, 25, Block VIII, to the south-eastern corner of the said Section 25; thence in a south-westerly direction generally adjoining the said Section 25, and terminating at its junction with the Waimapu River; being a distance of seven miles and three-quarters, more or less: as the said road is more particularly delineated on the plan marked P.W.D. 37476, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

Licensing George Peters to use and occupy a Part of the Foreshore of Porirua Harbour as a Site for a House and Outbuilding.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-sixth day of April, 1915.

Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under the Harbours Act, 1908 (hereinafter called “the said Act”), George Peters (hereinafter called “the licensee”) has applied to the Governor in Council for a license under the said Act to occupy a part of the foreshore of Porirua Harbour, in order to erect and maintain a house and outbuildings thereon; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited a plan in the office of the Marine Department at Wellington (marked M.D. 4419), showing the area of foreshore intended to be occupied, and the manner in which it is proposed to erect the said house and outbuildings:

And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation, and the said plan has, prior to the making of this Order in Council, been approved by the Governor in Council:

And whereas it is expedient that a license should be granted and issued to the licensee under the said Act for the purpose aforesaid, on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore on which the said house and outbuildings are to be erected, as shown on the plan so deposited as aforesaid, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.


SCHEDULE.

  1. IN these conditions the term “Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

  2. The concessions and privileges conferred by this Order in Council shall extend and apply only to the part of the foreshore necessary for the erection of the house and outbuildings as shown on the plan marked M.D. 4419.

  3. In consideration of the concessions and privileges granted by this Order in Council the licensee shall, on being supplied with a copy thereof, pay to the Minister an annual sum of £2 payable in advance, dating from the date hereof, the first of such payments to be made on the licensee being supplied with a copy of this Order in Council.

  4. His Majesty or the Governor, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into,
