Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said proceedings; and doth hereby order and declare that the deposit of the special roll and the said public notifications of the special order shall be valid to all intents and purposes as though the special roll had been deposited in the proper order, and as though the public notification had been published in the proper manner, and that the proceedings in connection with the said loan shall not be called into question by reason only of the irregularities aforesaid.

Declaring Road-lines through Land in the Wither Settlement, Marlborough Land District, to be closed.


LIVERPOOL, Governor.

WHEREAS a report has been received from the Surveyor-General from which it appears that the roads described in the Schedule hereto are unformed and unused, and that the said roads intersect land acquired under the Land for Settlements Act, 1908, and are not suitable to the subdivision of such land :

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of section eighty of the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do by this notice hereby close the roads hereinafter described; and I do hereby declare that the said roads shall thereupon become subject to the said Act.

Notifying the Proposed Exchange of Crown Land in the Marlborough Land District for other Land.


LIVERPOOL, Governor.

WHEREAS by section one hundred and forty-two of the Land Act, 1908, as amended by section seventeen of the Land Laws Amendment Act, 1913, it is enacted that it shall be lawful for the Governor, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1908, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive by way of equality of exchange any sum not exceeding twenty-five per centum of the estimated value of the Crown land so granted :

And whereas, in the opinion of the Governor, it is expedient to exchange the Crown land described in the First Schedule hereto for the land of equal value described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare that it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.


FIRST SCHEDULE.

DESCRIPTION OF CROWN LAND AUTHORIZED TO BE EXCHANGED.

ALL that area in the Marlborough Land District, containing by admeasurement 27,464 acres, more or less, situated in Blocks VI, VII, XI, XII, XIII, Whernside Survey District, and Blocks VII, VIII, XI, and XII, Tapuaenuku Survey District. Commencing at Tapuaenuku Trig. Station and bounded generally towards the north-west by Run 153 along the Kaikoura Range, 33926·9 links, to Trig F; thence towards the north by Crown lands, 22138·1 links, to Trig B; thence again towards the north-west and north by Crown lands and Run 154, 44825·9 links, to the north-western corner of Section 9, Block VII, Whernside Survey District; thence towards the east by the western boundary of that section and its continuation to and across the Swale Stream and a reserve along the bank of said stream, 6500 links; thence towards the north-east and north by the reserve, along the Swale and Wharf Streams, to the north-western corner of Section 3, Block VIII, Whernside Survey District; thence again towards the north-east by Sections 3, 9, and 10, Block VIII, and Sections 11, 12, and 13, Block XIII, Whernside Survey District, 31910 links, to a reserve along the Boundary Stream; thence towards the east and south by that reserve to the Clarence River; thence generally towards the south by a reserve along that river to a point on a spur from Division Hill; thence towards the south-west by Crown lands, part Section 106, and again by Crown lands, 49042·2 links, to Tapuaenuku Trig. Station, the point of commencement: saving and excepting Sections 12, 13, 14, 15, 107, 108, 109, and 110, and part 106, Ottley Fells Run, Clarence District, and the roads adjoining same; also the beds of the Ouse, Mead, and Dee Streams, and the reservation along the banks of same, and reserving to the Crown the right of access along the pack and driving track from A to B shown on plan referred to below, and also the right at any time to lay off and legalize, without compensation, a properly graded road in exchange for the present pack and driving track: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 6022/143, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. SECOND SCHEDULE.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

ALL those areas in the Marlborough Land District, containing by admeasurement 11,288 acres 3 roods 38 perches, more or less, being Sections Nos. 1, Block IV, 1, Block VII, 1 and 2, Block VIII, Tone Survey District, also Sections Nos. 1 to 11 inclusive, 20 to 30 inclusive, 33, 34, 40, 41, 42, 43, and 75 to 105 inclusive, and part Section 106, Ottley Fells Run, Clarence District, situated in Blocks IV, VII, and VIII, Tone Survey District, I, II, and V, Kaitarau Survey District, and XI, XII, XIII, XIV, and XV, Tapuaenuku Survey District; as the same are delineated on the plan marked L. and S. 6022/143, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured green.

As witness the hand of His Excellency the Governor, this second day of February, one thousand nine hundred and fifteen.

Notifying Lands in Hawke’s Bay Land District for Sale by Public Auction.


LIVERPOOL, Governor.

IN pursuance of the powers and authorities conferred upon me by the one-hundred-and-twenty-sixth section of the Land Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby appoint Friday, the twenty-sixth day of March, one thousand nine hundred and fifteen, as the time at which the lands described in the Schedule hereto shall be sold by public auction; and I do hereby fix the prices at which the said lands shall be sold as those mentioned in the said Schedule hereto.
