“Undrained area” means all that portion of the One-tree Hill Road District not included in the Drainage area as above defined.

“Owner” means the owner of any property as defined by the Municipal Corporations Act, 1908.

“Occupier” means the occupier of any property as defined by section 2 of the Rating Act, 1908.

“Cesspit” shall not be deemed to include any efficient septic tank constructed to the satisfaction of the Board.

  1. The owner of every property within the drainage area upon which a dwellinghouse or other building is erected shall, upon receiving notice in writing from the Board to provide and construct a private drain from such property to connect with a sewer, or to provide and affix sanitary appliances in and to any existing or in and to any new private drain, or to execute or do any other matters or things which the Board may lawfully require such owner to execute or do, proceed to comply with such notice within the time therein limited.

  2. No person shall bury, or cause or allow or permit to be buried or deposited, in or on the ground any nightsoil in any portion of the drainage area.

  3. No person shall construct, maintain, or use a cesspit within the One-tree Hill Road District.

  4. Every owner or occupier of any land in the One-tree Hill Road District upon which a cesspit exists at the date of these by-laws coming into force shall clear out the same and fill up the same with dry earth, ashes, or other effective deodorant.

  5. If the owner or occupier of any land whereon any cesspit is situated fails, neglects, or refuses to clean out and fill up the same the Board may cause the same to be done, and may recover the cost of so doing from such owner or occupier or either of them.

  6. The occupier of every building used wholly or partly as a dwelling and situated in the undrained area, and not provided with an efficient septic tank constructed to the satisfaction of the Board, shall continuously employ the services of the Board’s nightsoil contractor for the removal of all faecal and other matter deposited in any privy or water-closet situated on the premises occupied by such occupier, and shall pay to the Board the annual fee of £1 10s. in respect of such removal. Such fee shall be deemed to be for the period from the 1st day of April in each year to the 31st day of March in the succeeding year, and shall be included in the demand for the general rates payable in respect of the property on which the dwelling is situated, and shall be payable accordingly.

  7. Any person who shall do, or cause or permit or allow to be done, anything contrary to these by-laws or any of them, or who shall omit to do anything required by these by-laws or any of them to be done, shall be deemed to have committed a breach of these by-laws.

  8. Any person committing a breach of these by-laws shall be guilty of an offence, and shall be liable to a penalty not exceeding £5 for every such offence, and in case of a continuous offence to a penalty of not more than £5 for each day during which such offence continues.

  9. The provisions of any existing by-laws of this Board which are in any way contradictory of or repugnant to these by-laws are hereby repealed.

I hereby certify that the foregoing by-law was duly made by the One-tree Hill Road Board by special order, the resolution in respect of which was passed at a special meeting of the said Board convened for that purpose on the 6th day of August, 1915, and confirmed at a subsequent meeting of the said Board held on the 10th day of September, 1915, and that all public notifications, notices, deposits, and other requirements of the Road Boards Act, 1908, and its amendments, and the Public Health Act, 1908, and its amendments, have been duly complied with in respect to such special order.

THE following special order, made by the Taranaki County Council, is published in accordance with the provisions of the Counties Amendment Act, 1913.

SPECIAL ORDER.

Merging Portion of Moa Road District into the County of Taranaki.

IN pursuance and exercise of the powers conferred on it by section 10 of the Road Boards Act, 1908, and section 34 of the Counties Amendment Act, 1913, the Council of the County of Taranaki resolves, by way of special order, that the portion of the Moa Road District as described in the Schedule hereunder be annexed to the adjoining outlying district of the Mangorei Riding of the County of Taranaki, and cease to form part of the Moa Road District as from date of coming into force of this special order—namely, 31st March, 1916.

Schedule.

All that area in the Provincial District of Taranaki bounded as follows: Commencing from a point in the middle-line of the Waiwakaiho Stream where the same is intercepted by the northern boundary of the Junction Road; thence along the middle-line of the Waiwakaiho Stream to a point in line with the south-east boundary of Section 48, Block 10, Paritutu Survey District; thence generally towards the north by a right line to the south-west corner of said Section 48 and by the southern and part of the eastern boundaries of said Section 48 to the south-west corner of Section 44; thence by the southern boundary of said Section 44 and a continuation thereof to the east side of the Egmont Road; thence by the east side of the Egmont Road to the south boundary of Section 45; thence by the south boundary of said Section 45 and the south boundary of part Section 32 to the Upland Road; thence by a right line across the Upland Road and the south boundary of other part of Section 32, Block 11, Paritutu Survey District, to the west boundary of Section 41; thence by part of the west and by the southern boundaries of Section 41 to the King Road; thence by the west side of the King Road to a point in line with the south boundary of Section 80; thence by a right line across the King Road and the south boundary of Section 80 to the Hursthouse Road; thence by a right line across the Hursthouse Road to the south-west corner of Section 55; thence by the south boundary of said Section 55, part of west and the southern boundaries of Section 203, to the east side of the Mountain Road; thence generally towards the east by the east side of the Mountain Road to the northern boundary of the Borough of Inglewood; thence towards the south-west by the north-east boundary of the Borough of Inglewood to the Waiongona Stream, along the Waiongona Stream to where the same is intercepted by the Junction Road, and thence along the northern side of the Junction Road to the commencing-point.

The common seal of the Chairman, Councillors, and Inhabitants of the County of Taranaki was affixed hereto by the Chairman, Joseph Brown, duly authorized by resolution of the Council passed on the 7th day of September, 1915.
