Telephone Exchanges.—Charges for Continuous Attendance.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House at Wellington, this nineteenth day of January, 1915.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the first day of November, one thousand nine hundred and eleven, and published in the New Zealand Gazette of the second day of November, one thousand nine hundred and eleven, regulations were made, under the authority of the Post and Telegraph Act, 1908 (hereinafter termed “the said Act”), inter alia, for the purpose of determining the hours of attendance to be observed at telephone exchanges, and fixing the charges to be paid by subscribers in connection therewith: And whereas it is expedient to amend such regulations in the manner hereinafter set forth:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and all other powers and authorities in that behalf enabling him, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke regulations numbered 11 and 23 in the Schedule to the abovere cited Order in Council, and in lieu thereof doth hereby make the regulations set forth in the Schedule hereto; and doth hereby declare that such regulations shall be read as part of the hereinbefore-mentioned regulations, and shall have effect as from the publication of this Order in Council in the New Zealand Gazette, but so that such regulations shall not operate to prevent compliance with a requisition signed by a two-thirds majority of subscribers to a telephone exchange, for business and private connections taken together, to revert from lengthened to shortened periods of attendance at such exchange if the hours of attendance were lengthened before the date of this Order in Council.

SCHEDULE.

CHARGES.

  1. In addition to the entrance fee of £1, the charge per annum payable in respect of the hire of any telephone instrument connected with a Government telephone exchange is as follows:—

For an exclusive circuit,—

At exchanges which are open continuously—

Business establishments .. .. .. £ 7
Private residences .. .. .. 5

Or if not less than two-thirds of the business subscribers and not less than two-thirds of the private-residence subscribers at any time express in writing, addressed to the Secretary of the Post and Telegraph Department, their desire in that behalf

For each business and private-residence subscriber, at the rate of .. .. .. 6

Such expression as aforesaid shall be deemed to be operative until reversed by an expression of the desire of not less than two-thirds of the business subscribers and not less than two-thirds of the private-residence subscribers that the annual rates be £7 and £5 respectively.

At exchanges which are not open continuously—

Business establishments and private residences.. 5

Additional exchange connections to the same premises, £1 per annum less.

  1. The following hours of attendance shall be observed at the telephone exchanges, according to the number of paying subscribers connected therewith:—

1 to 50 (inclusive): 9 a.m. to 5 p.m.
51 ,, 100 ,, 8 ,, 8 ,,
101 ,, 125 ,, 8 ,, 10 ,,
126 ,, 150 ,, 8 ,, midnight.
151 and over: Open continuously, if at any time not less than two-thirds of the business subscribers and not less than two-thirds of the private-residence subscribers express in writing, addressed to the Secretary of the Post and Telegraph Department, their desire that the telephone exchange be so opened. Such expression as aforesaid shall be deemed to be operative until reversed by an expression of the desire of not less than two-thirds of the business subscribers and not less than two-thirds of the private-residence subscribers that the hours observed be from 8 a.m. to midnight.

Notifying the Proposed Exchange of Crown Land in the Marlborough Land District for other Land.

LIVERPOOL, Governor.

WHEREAS by section eleven of the Scenery Preservation Amendment Act, 1910, it is enacted that it shall be lawful for the Governor, whenever he deems it expedient for the purposes of scenery-preservation, to grant in fee-simple any area of Crown land in exchange for the fee-simple of any other land which in his opinion is of approximately equal value, and that such exchange may be made under the provisions of section one hundred and forty-two of the Land Act, 1908:

And whereas, in the opinion of the Governor, it is expedient to exchange the Crown land described in the First Schedule hereto for the lands described in the Second Schedule, and the owner of the lands described in the Second Schedule has agreed to such exchange:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare that it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the areas of land described in the Second Schedule.

FIRST SCHEDULE.

DESCRIPTION OF CROWN LAND AUTHORIZED TO BE EXCHANGED.

ALL that area in the Marlborough Land District, containing by admeasurement 1 acre 3 roods 5 perches, more or less, being Section 16 (originally part of Section 13), Block XI, Linkwater Survey District. Bounded towards the north, east, south, and south-west generally by a public road, 66·9 links, 65 links, 146·3 links, 103·3 links, 99 links, 73·6 links, 70·1 links, 76·9 links, 32·2 links, 28·6 links, 146·3 links, 118 links, 14·6 links, 147·3 links, 151·5 links, 141·5 links, and 125·1 links; and towards the north-west by Section 6A, Block VII, Linkwater Survey District, 464·7 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 649/B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

SECOND SCHEDULE.

DESCRIPTION OF LANDS TO BE OBTAINED IN EXCHANGE THEREFOR.

ALL that area in the Marlborough Land District, containing by admeasurement 1 acre 3 roods 20 perches, more or less, being Section 13 (originally part of Section 6A), Block VII, Linkwater Survey District. Bounded towards the north-east by Whenua-nui Bay; towards the south by remaining portion of Section 6A, Block VII, Linkwater Survey District, 412 links; and towards the west by Section 13, Block XI, Linkwater Survey District, and the abutment of a reserve along the coast, 405·6 links, 336 links, and 80 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 649/B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered green.

Also all that area in the Marlborough Land District, containing by admeasurement 1 acre 1 rood, more or less, being Section 14 (originally part of Section 6A), Block VII, Linkwater Survey District. Bounded towards the east and north-east by the abutment of a reserve along the coast and by Section 12, Block VII, Linkwater Survey District, 80 links, 232·8 links, and 377·5 links; towards the south-east by remaining portion of Section 6A, Block VII, Linkwater Survey District, 242 links; and towards the west generally by Whenua-nui Bay: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 649/B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered green.

Also all that area in the Marlborough Land District, containing by admeasurement 1 acre 3 roods 30 perches, more or less, being Section 15 (originally part of Section 6A), Block VII, Linkwater Survey District. Bounded towards the north-east by Section 13, Block XI, Linkwater Survey District, 390·5 links and 300 links; towards the south-east by Section 13 aforesaid, 466·7 links; and towards the west generally by a public road, 14·8 links, 188·8 links, 78·6 links, 62·4 links, 41·1 links, 160·8 links, 109 links, 97·2 links, 110·6 links, 86·2 links, 101·4 links, 48 links, and 69·9 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 649/B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered green.
