New Street, Ponsonby, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908.
LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government House at Wellington, this twenty-third day of June, 1914.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor, by Order in Council, thinks fit to impose:
And whereas the Auckland City Council, being the local authority having control of the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it affects the said street described in the Schedule hereto.
SCHEDULE.
ALL that street known as New Street, Ponsonby, in the City of Auckland, commencing at its junction with College Road, and proceeding thence in a north-easterly direction to its point of termination at the Waitemata Harbour, being a distance of 1,700 ft., more or less; as the said street is more particularly delineated on the plan marked P.W.D. 35551, and deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

Portion of the South-eastern Side of Richmond Street, in the Borough of Patea, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Wellington, this twenty-third day of June, 1914.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose, and may refer to one or both sides of the road or street:
And whereas the Patea Borough Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as the said portion of street, did, by resolution, declare that the provisions of the said section one hundred and seventeen should not apply to the said portion of street:
And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the south-eastern side of the said portion of street, subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building or part of a building shall be erected at any time on the south-eastern side of the said portion of street, within a distance of thirty-three feet of the centre-line of the said portion of street.
SCHEDULE.
ALL that portion of Richmond Street, in the Borough of Patea, Taranaki Land District, fronting Subdivisions 15, 16, 17, 18, and 22 of Suburban Section 46, Borough of Patea, being a distance of 5 chains, more or less; as the said portion of street is more particularly delineated on the plan marked P.W.D. 35686, deposited in the office of the Minister of Public Works at Wellington, in the Provincial District of Wellington, and thereon coloured blue.

Consenting to Land being taken for the Purposes of a Recreation-ground in the City of Auckland.
LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government House at Wellington, this twenty-third day of June, 1914.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the Public Works Act, 1908, it is, in section fifteen thereof, inter alia, enacted that, except for the purpose of a railway or defence purposes, or for the purposes of any other work to be made under the authority of a special Act, nothing in this Act contained shall authorize the taking of any land occupied by any building, yard, garden, or vineyard, or in bona fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor in Council:
And whereas part of the land described in the Schedule hereto is occupied by buildings, yards, orchard, and ornamental parks, and the Minister of Public Works has recommended the Governor to issue an Order in Council under the said Act consenting to the taking of the said land for the purposes of a recreation-ground in the City of Auckland:
Now, therefore, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes above mentioned.
