Driving round corners or over bridges.

  1. No person shall ride or drive any animal or vehicle round a corner or over a bridge or culvert faster than a walking-pace.

Closing bridges to heavy traffic.

  1. The Council may from time to time close any bridge for traffic exceeding 1½ tons in weight by placing in some conspicuous place at each end of such bridge a board having painted thereon the words “Closed for engines and vehicles exceeding 1½ tons in weight,” in letters not less than 3 in. in length; and so long as such bridge is closed to such traffic as aforesaid no person shall take or drive on or across such bridge any vehicle, engine, or machine which shall itself or together with any thing or things transported thereon weigh more than 1½ tons avoirdupois.

Number of cattle over bridges.

  1. No person shall drive any number of great cattle or horses exceeding twenty-five in number over any bridge at any one time.

Furious riding.

  1. No person shall furiously or negligently ride or drive any animal, vehicle, or conveyance on any road or public place.

Animals to be made secure before being left.

  1. No person shall leave unattended on any road or public place any horse or other animal harnessed to any vehicle, unless such animal shall be secured by some efficient means to prevent such animal from bolting or wandering on or along a road.

Rule of the road.

  1. The driver of any vehicle shall keep to the left-hand side of the road when meeting any other vehicle or a motor-car, or any horseman or cyclist, and shall drive to the right-hand side of the road when overtaking any other vehicle or a motor-car, or any horseman or cyclist, and shall in all cases leave a reasonable portion of the road for any vehicle, motor-car, person, or animal passing him.

Private crossings.

  1. Where vehicle or animal traffic to or from any private premises usually takes place, the Council may, by fourteen days’ notice delivered to the occupier or sent to him through the ordinary course of post, require him to construct crossing accordingly.

Private crossings to be made.

  1. Every crossing from the formed or the metalled portion of any road to give access to any private gateway or private road shall be kept in good order and repair to the satisfaction of the County Engineer or Inspector by the occupier of the premises in connection wherewith such crossing shall be used.

Culverts or drainpipes on crossings.

  1. All culverts or drainpipes placed in connection with any such crossing shall be laid to the satisfaction of the Engineer or Inspector, and shall be kept in good order and repair by the occupier for the time being of such premises.

SECTION 6.

Offences on Public Roads and Places.

  1. Any person shall be guilty of an offence who—
    Being in charge of any bull, stallion, or other entire animal, permits it to cover within sight of any public place.

  2. Allows any horse, sheep, pig, goat, or other cattle under his charge to be at large or to loiter in any road or public place.

  3. Leaves, without reasonable excuse, upon any public road any carriage, cart, plough, harrow, or other vehicle or implement without any horse or other animal of burden harnessed thereto, or plays any game to the annoyance of any persons upon any road or footpath, or obstructs any road or footpath, whether by allowing any cart or animal to remain across the same, or by placing or leaving upon such road or footpath any machine, article, material, or goods, or carries upon his shoulders or otherwise upon any footpath any implements, tools, materials, or load projecting in such a manner as to be to the danger or obstruction of persons using such footpath, or otherwise obstructs any road or footpath.

  4. Throws or places any glass, orange-peel, filth, dirt, tins, sawdust, rubbish, or any other matter of a similar nature upon any road, court, alley, or public place whatsoever.

  5. Blasts any rock, stone, or timber on or near any road or public place without the permission of the Council, or does not attend to any directions in regard thereto given by the Council.

  6. Leaves any hole, excavation, or dangerous formation in, upon, or near any road or public place without fencing or enclosing the same, or keeping a light burning upon such enclosure from sunset to sunrise.

  7. Cuts, marks, breaks, or defaces any bridge, tree, notice-board, mile-post, finger-post, or other county property or any county building.

  8. Without first having obtained permission of the Council, writes or paints any sign on any road, bridge, or public place, or on any structure thereon respectively erects any scaffolding or telephone or electric-light wire, constructs or places any culvert or water-pipe on or in any road or public place, or removes any posts, trees, plants, grass-seed, soil, gravel, or other material from, or lights any fire on a road or public place, or places any timber, brick, stone, or other building-material on a road so as to obstruct or endanger persons using the road.

  9. Leaves any dead, dying, or diseased beast or animal on any road or public place, or throws or leaves any dead animal or any part thereof on any road or public place, or throws or leaves the same on any private property within 10 chains of any road or public place, whereby a nuisance from offensive smell or otherwise is occasioned to persons using the road or public place.

  10. Leaves any tree or other obstruction fallen from property in his occupation upon any road for a longer period than is reasonably necessary to remove the same.

  11. Keeps any pigs or other animals herded near any road so as to be offensive or dangerous to travellers along the road.

  12. Keeps any entire animal in any paddock adjacent to any road unless secured by a strong and sufficient fence.

  13. No person shall wilfully or unlawfully extinguish any road lamp, or wilfully injure any road post or lamp.

  14. No person shall in any way impede or obstruct the free flow of water through any culvert or drainpipe or along any channel or watertable constructed in connection with any public road or any footpath.

  15. No person shall damage any watertable on any road, or drive with a wheel in any such watertable.

  16. It shall be an offence to use any catamarans or wheeled sledge on any roads within the county.

PENALTIES.

Any person committing a breach of any of these by-laws shall be liable to such penalty, not exceeding £5, as the Court in its discretion may see fit to impose; and in case of a continuing offence to a further and like penalty for each day or part of a day on which such breach shall be continued after conviction or after written notice of such breach shall be given by or on behalf of the Council to the offender; provided always that the penalties to be recovered in any one proceeding or any continuing breach shall in no case exceed £100.

If default be made in the carrying into effect of anything required to be made or done by these by-laws the Council may cause the same to be made or done, and all expenses incurred by the Council in so doing shall be recoverable from any person who under these by-laws should have made or done the same.

These by-laws shall come into force on the 1st day of May, 1914, and shall apply to the whole County of Rodney.

HARBOUR BY-LAW.

In pursuance of the powers vested in the Rodney County Council, acting as Harbour Board for the Loan District of Omaha, a special order making by-law levying dues at Leigh Wharf was made on the twentieth day of January, 1914, and confirmed on the seventeenth day of February, 1914, as follows:—

Special Order.

That the wharf dues for regular trading vessels using the Leigh Wharf be raised to £5 per half-year in lieu of sixpence per registered ton minimum now in force on regular trading vessels using the Leigh Wharf.

The half-year to commence on 1st July, 1914.
