Revoking Order in Council licensing the Akitio Totara Saw-
milling Company (Limited) to use and occupy a Part of the
Foreshore at Akitio as a Site for a Wharf.

At the Government Buildings, at Wellington, this third day
of March, 1914.

Present:

THE RIGHT HONOURABLE W. F. MASSEY PRESIDING IN
COUNCIL.

WHEREAS by Order in Council dated the twenty-sixth
day of January, one thousand nine hundred and five,
and published in the New Zealand Gazette No. 9, of the
second day of February, one thousand nine hundred and
five, His Excellency the Governor in Council did, in pursu-
ance of the provisions of the Harbours Act Amendment Act,
1883 (hereinafter called “the said Act”), license the Akitio
Totara Sawmilling Company (Limited) to use and occupy a
part of the foreshore at Akitio, in the Provincial District of
Hawke's Bay, as a site for a wharf:

And whereas it is desirable that the said license should be
revoked:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and
in pursuance and exercise of the power and authority con-
ferred upon him by the said Act, and of all other powers and
authorities enabling him in that behalf, doth hereby revoke
and determine the said recited Order in Council of the twenty-
sixth day of January, one thousand nine hundred and five,
and the rights and privileges conferred thereby.

Roman Catholic Bishop of Auckland declared a Leasing
Authority under the Public Bodies' Leases Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this third day
of April, 1914.

Present:

THE RIGHT HONOURABLE W. F. MASSEY PRESIDING IN
COUNCIL.

WHEREAS the Roman Catholic Bishop of Auckland is
a person having power to lease lands held in trust,
reserved, or set apart for religious, charitable, and educational
purposes, and has requested the Governor in Council to
declare him to be a leasing authority within the meaning of
the Public Bodies' Leases Act, 1908:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in compliance with such request,
and in exercise of the powers in this behalf conferred by the
above-mentioned Act, and acting by and with the advice
and consent of the Executive Council of the said Dominion,
loth hereby order and declare that the Roman Catholic
Bishop of Auckland is a leasing authority within the meaning
of the Public Bodies' Leases Act, 1908.

Validating Election to fill Extraordinary Vacancies in the
Waverley Town Board.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of
April, 1914.

Present:

His Excellency THE GOVERNOR IN COUNCIL.

WHEREAS certain extraordinary vacancies recently
occurred in the Waverley Town Board: And where-
as it was necessary to hold an election to fill such vacancies,
as prescribed by the Town Boards Act, 1908, and the Local

Elections and Polls Act, 1908: And whereas there being no
Chairman of the said Board after such vacancies occurred,
the direction to hold such election to fill such vacancies
required by section twenty-two of the Town Boards Act,
1908, could not be given by the proper officer: And whereas
in default of there being a Chairman of the said Board as
aforesaid, the Clerk thereof gave notice of such vacancies to
the Returning Officer in pursuance of section thirty-nine of
the Local Elections and Polls Act, 1908: And whereas an
election to fill such vacancies was held on the nineteenth day
of March, one thousand nine hundred and fourteen, and at
such election

JOHN MCKAY LINKLATER,
REGINALD PERCY PALMER,
SAMUEL JOHN PRICE,
ISAAC BASON, and
REGINALD McDONALD

were declared to be elected members of the said Waverley
Town Board:

And whereas doubts have arisen as to the regularity of the
said election being held on such notice from the Clerk of the
said Board: And whereas the said election was not held
within the time prescribed by the Local Elections and Polls
Act, 1908: And whereas it is expedient to validate the said
election:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by section twenty-four of the Local Elec-
tions and Polls Amendment Act, 1913, and in pursuance and
exercise of every other power and authority enabling him in
that behalf, and acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
validate the said election of the said

proposed to be raised by the Ohura County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
seventh day of March, 1914.

Present:

THE HONOURABLE W. FRASER PRESIDING IN COUNCIL.

WHEREAS the Ohura County Council lately proposed
to raise a loan of two thousand eight hundred and
thirty-five pounds under the Local Bodies’ Loans Act, 1908
(hereinafter referred to as “the said Act”), and its amend-
ments, for the purpose of metalling the Harvey-Tokirima
Road:

And whereas as the last notice of intention to raise the
above loan was advertised on the twentieth day of Sep-
tember, one thousand nine hundred and twelve, and the poll
was taken on the nineteenth day of October, one thousand
nine hundred and twelve, there was an interval of twenty-
nine days, instead of not more than three weeks:

And whereas it appears that the ratepayers have not been
misled by such irregularity, and it is expedient to validate
the same:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby declare that
the said poll shall be valid to all intents and purposes as
though the same had been taken within the proper time,
and that the proceedings relative to such loan shall not be
called in question by reason only of the irregularity aforesaid.
