Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

to be the Waikaka Domain Board, having the control of the land described in the said Schedule hereto for the purposes of and subject to the provisions of the said Act; and doth hereby appoint Friday, the thirtieth day of January, one thousand nine hundred and fourteen, at 8 o’clock p.m., as the time when, and the Public Hall, Waikaka, as the place where, the first meeting of the Board shall be held.

SCHEDULE.
WAIKAKA DOMAIN.
ALL that area in the Southland Land District, containing by admeasurement 10 acres, more or less, being Section 84, Block XIV, Chatton Survey District. Bounded towards the north-east by Section 85, Block XIV, Chatton Survey District, 900·2 links; towards the south-east by said Section 85 and Section 90 of said block, 1100 links; towards the south-west and again towards the south-east by a road, 736·8 links and 203·4 links respectively; and towards the north-west by Section 83 of said block, 1221·4 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 1205/61, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

License authorizing the Taihape Borough Council to use Water from the Hautapu River for the Purpose of generating Electricity and to erect Electric Lines in the Borough of Taihape.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-second day of December, 1913.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section five of the Public Works Amendment Act, 1908, it is enacted that the Governor may from time to time by Order in Council grant to any person or body corporate a license to use water from any fall, river, stream, or other source for the purpose of generating electricity for electric light, mechanical power, or other uses, and to exercise in respect of that purpose any of the powers and authorities specified in that behalf in the said section: And whereas it is further provided by the said section that any such license may confer upon the licensee a right at any time or times during the continuance of the license (but subject to such conditions and restrictions as are expressed in the license) to enter upon any road, railway, or other land, whether vested in or occupied by the Crown or any other person or body corporate, and there to construct, erect, lay down, maintain, renew, or repair all such cables, wires, and other things as are required for the transmission of electricity between the fall, river, stream, or other source aforesaid and any place to which the licensee is authorized to transmit electricity in pursuance of the license:
And whereas the Taihape Borough Council (which, with its successors and assigns is hereinafter referred to as “the licensee”) has applied for a license under the said section to take and use water from the Hautapu River, in the Provincial District of Wellington (hereinafter referred to as “the said river”), for the purpose of generating electricity as aforesaid, and it is expedient to issue such license accordingly:
Now, therefore, in pursuance and exercise of the powers conferred upon him as aforesaid, and of the powers conferred by section two of the Public Works Amendment Act, 1911, and of all other powers enabling him in that behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to the licensee, subject to the terms and conditions hereinafter set forth, a license to take and use from the Hautapu River aforesaid, for the purposes hereinafter set forth, a stream of water (hereinafter referred to as “the said water”) not exceeding sixty-seven cubic feet per second at any one time; and also to erect and maintain electric lines for lighting, heating, and power purposes as hereinafter described.

TERMS AND CONDITIONS OF LICENSE.
- In this license—
“Consumer’s wires” means any electric lines on the consumer’s premises which are connected with the Council’s electric lines.
“Council” means the Taihape Borough Council.
“Distribution line or lines” means the portion of any line from which service wires are connected for the purpose of supplying consumers.
“Earthed” applied to any conductor means that such conductor shall be so connected to the general mass of earth as to ensure at all times an immediate and safe discharge to earth of electric energy.
“Electric line” means any wire, wires, conductor, or other means used for conveying, transmitting, or distributing electricity for power, lighting, or heating purposes, and includes any instrument, insulator, casing, tubing, pipe, covering, or post enclosing or supporting an electric line or anything connected therewith.
“Electric telegraph line” means any wire, wires, or cables belonging to the Post and Telegraph Department, or erected under authority granted by the Minister of Telegraphs.
“Inspecting Engineer” means the engineer or other officer appointed by the Minister of Public Works for the purpose of inspecting the works to be constructed or maintained under this license.
“Minister” means the Minister of Public Works.
“Pressure” means difference of electric potential between any two conductors through which supply of energy is given, or between any part of either conductor and the earth.
“Street” includes road.
“Telegraph” includes telephone.

The said water shall be used solely for the purpose of generating electricity.

The said water shall be taken from the said river at the headworks, situated about 2 chains up the said river from the bridge over the said river on the main road in the Borough of Taihape, at a point indicated on the plan marked P.W.D. 33664, deposited in the office of the Minister of Public Works, at Wellington.

From the said headworks the water shall be conducted in a southerly direction by means of a tunnel for a distance of about 9 chains to the power-house, situated on the right bank of the said river, the positions of the said tunnel and power-house being more particularly delineated on the plan referred to in the last preceding clause hereof. All water taken from the said river by the licensee in pursuance of this license shall be returned thereto at the power-house.

The licensee shall, in respect of his license, pay to the Receiver of Land Revenue at Wellington, or otherwise as the Minister may from time to time require, a fee of one peppercorn per annum if demanded.

This license shall, unless sooner determined in accordance with the provisions hereinafter expressed, continue in force for a period of forty-two years, commencing on the 1st January, 1913. Upon the expiry of the said term, or upon the sooner determination of this license by revocation or otherwise, all rights hereby granted to the licensee shall thereupon cease and determine, but such expiration or determination shall not relieve the licensee of any liability theretofore incurred under this license.

This license may be assigned by the licensee with the express consent in writing of the Governor in Council.

The licensee is hereby authorized to construct, maintain, and use the following works for the purposes of this license, the position of the said works being indicated on the plan marked P.W.D. 33664 hereinbefore referred to:—
(a.) Headworks consisting of a dam and necessary intake.
(b.) Tunnel leading from such dam to the power-house hereinafter referred to.
(c.) A power-house with all necessary equipment, including water-turbines, generators, transformers, lightning-arresters, switchboards, switches, exciters, and other appliances for generating electricity.
