Revoking Part of a Proclamation taking Land for a Portion of the East Coast Main Trunk Railway (Maunganui Bluff–Te Puke Section), and for Road-diversions in connection therewith.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation, or the making or gazetting thereof, the Governor may, by a subsequent Proclamation gazetted, revoke the former Proclamation, either wholly or so far as he thinks necessary:

And whereas it is found that the pieces of land described in the Schedule hereto, being part of the land taken for a portion of the East Coast Main Trunk Railway (Maunganui Bluff–Te Puke Section), and for road-diversions in connection therewith, by a Proclamation made under the Public Works Act, 1908, dated the eighth day of May, one thousand nine hundred and thirteen (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 41, of the fifteenth day of the same month, are incorrectly described: And whereas compensation in respect of the taking of the said land has not been paid or awarded:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects the pieces of land described in the Schedule hereto, being part of the land taken by the said Proclamation.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this first day of November, in the year of our Lord one thousand nine hundred and thirteen.

Amending Order in Council vesting Management of Wharf at Rawene, in Hokianga Harbour, in the Hokianga County Council.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of November, 1913.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the second day of February, one thousand nine hundred and eleven, and published in the New Zealand Gazette No. 11, of the ninth day of the same month, the management of the wharf at Rawene, in Hokianga Harbour, was vested in the Hokianga County Council, subject to the conditions set forth in the First Schedule to the said Order in Council:

And whereas it is desirable to amend the said Order in Council in the manner hereinafter described:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke clause five of the First Schedule to the hereinbefore-recited Order in Council, and doth hereby substitute the following clause in lieu thereof:—

  1. The revenue received on account of the said wharf by the Council shall be applied to keeping the said wharf, and all erections on or in connection with such wharf, in good order and repair, and to the installation and maintenance of a lighting plant for lighting the said wharf, the public thoroughfares of the township of Rawene, and the public buildings under the control of the Council: Provided that that portion of the said revenue which is used to defray the cost of lighting the said public thoroughfares and public buildings shall, within a reasonable time, be refunded to the Wharf Account from the general revenue of the Council.

Authorizing the Laying-off of a Street in the City of Auckland of a Width less than 66 ft. but not less than 50 ft.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of November, 1913.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section one hundred and seventy-eight of the Municipal Corporations Act, 1908, it is, inter alia, provided that where the configuration of any borough is such as that within any particular area or areas thereof it is difficult or inexpedient to construct streets of a width of sixty-six feet, as required by the said Act, the Governor may, by Order in Council defining the limits of such particular area or areas, authorize the Council to permit within such area or areas the construction of streets and private streets of a width less than sixty-six feet but not less than forty feet:

And whereas the configuration of part of the City of Auckland is such that within the area described in the Schedule hereto it is inexpedient to construct a street of sixty-six feet in width:

Now, therefore, in pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Auckland City Council to permit the laying-off of a street of a width less than sixty-six feet, but not less than fifty feet, within the area described in the Schedule hereto.

SCHEDULE.

ALL that area in the City of Auckland being part of Allotment 22 of Section 8 of the Suburbs of Auckland; as the said area is more particularly delineated on the plan marked P.W.D. 34315, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon bordered green.
