Marsden Kauri-gum Reserve described in the Schedule hereto shall be no longer subject to the provisions of the Acts aforesaid.


SCHEDULE.

ALL that area in the Auckland Land District, containing 25 acres, more or less, being part of Marsden Kauri-gum Reserve set apart by Order in Council, dated the 25th day of September, 1899, and published in the New Zealand Gazette No. 79, of 28th September, 1899. Bounded towards the north-east by northern portion of Allotment 7, Ruakaka Parish; towards the south-east by Allotment 70 of the aforesaid parish; towards the south-west by a public road; and towards the north-west by south-west portion of Allotment 7 and Allotment 5 of the aforesaid parish: as the same is delineated on the plan marked L. and S. 1913/567, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Withdrawing Land from the Operation of the Kauri-gum Industry Acts.


LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of September, 1913.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section thirty-three of the Kauri-gum Industry Act, 1908 (hereinafter termed โ€œthe said Actโ€), it is enacted that the Governor may by Order in Council declare that land set apart under the said Act as a kauri-gum reserve, and which is no longer required for the purpose of gum-digging, shall be no longer subject to the said Act, and thereupon the land shall cease to be a kauri-gum reserve, and shall be dealt with by the Land Board as ordinary Crown land; provided that such Order in Council shall only be issued in pursuance of a resolution of the Land Board, supported by such independent evidence as the Governor in Council deems necessary:

And whereas the Land Board of the Auckland Land District passed a resolution recommending that the portion of Kapiro Kauri-gum Reserve described in the Schedule hereto be declared to be no longer subject to the said Act, and such resolution was duly gazetted and publicly notified in accordance with section nine of the Kauri-gum Industry Amendment Act, 1910: And whereas no objection has been received to the said proposal, and it is deemed expedient to give effect to such recommendation:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section thirty-three of the Kauri-gum Industry Act, 1908, and section nine of the Kauri-gum Industry Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of Kapiro Kauri-gum Reserve described in the Schedule hereto shall be no longer subject to the provisions of the Acts aforesaid.


SCHEDULE.

ALL that area in the Auckland Land District, situated in Block XII, Kaeo, and Block VI, Kerikeri Survey Districts, Bay of Islands County, containing 352 acres, more or less, being portion of Kapiro Kauri-gum Reserve, set apart by Order in Council dated 6th May, 1901, and published in the New Zealand Gazette No. 46, of the 9th May, 1901, page 1020. Bounded towards the north-east and south-east generally by the Waipapa Stream; towards the south generally by a public road; and towards the west by a public road forming the eastern boundary of Section 13, Block XII, Kaeo Survey District; towards the north and again towards the west by Section 7 of last-mentioned block; and again towards the north and west by Section 1 of said Block XII: as the same is delineated on the plan marked L. and S. 1912/1292, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Declaring a Road-line through Land in the Clareview Settlement to be closed.


LIVERPOOL, Governor.

WHEREAS a report has been received from the Surveyor-General from which it appears that the road described in the Schedule hereto is unformed and unused, and that the said road intersects land acquired under the Land for Settlements Act, 1908, and is not suitable for the subdivision of such land:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of section eighty of the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do by this notice hereby close the road hereinafter described, and I do hereby declare that the said road shall thereupon become subject to the said Act.

CLAREVIEW SETTLEMENT.

As witness the hand of His Excellency the Governor, this seventeenth day of September, one thousand nine hundred and thirteen.

Land temporarily reserved as a Site for a Public Hospital in Block IV, Orahiri Survey District, Auckland Land District.


LIVERPOOL, Governor.

WHEREAS by the three-hundred-and-twenty-first section of the Land Act, 1908, it is enacted that the Governor may from time to time, either by general or particular description, and whether the same has been surveyed or not, reserve from sale temporarily, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby temporarily reserve from sale the land in the Auckland Land District described in the Schedule hereunder written, as a site for a public hospital.


SCHEDULE.

ALL that area in the Auckland Land District, containing by admeasurement 4 acres 1 rood 6 perches, more or less, being Section 7A, Block IV, Orahiri Survey District. Bounded towards the north-east by Section 7, Block IV, Orahiri Survey District, 821-4 links; towards the south-west by Otorohanga B 2 Section 1 Block, 1086-3 links; and towards the north-west by the Otorohanga-Kihikihi Road, 127-7, 202-3, 367-5, and 288-9 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 1913/571, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (Auckland Plan 12186, blue.)

As witness the hand of His Excellency the Governor, this twentieth day of September, one thousand nine hundred and thirteen.
