Revoking a Proclamation taking Land for the Purposes of Waterworks in Block XV, Patutahi Survey District, Cook County.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that the land, or any part thereof, is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation, or the making or gazetting thereof, the Governor may, by a subsequent Proclamation gazetted, revoke the former Proclamation, either wholly or so far as he thinks necessary : And whereas it is found that the land in Block XV, Patutahi Survey District, taken for the purposes of waterworks by a Proclamation made under the Public Works Act, 1908, and the Municipal Corporations Act, 1908, dated the first day of March, one thousand nine hundred and eleven (hereinafter termed "the said Proclamation"), and published in the New Zealand Gazette No. 17, page 882, of the ninth day of the same month, is not required for the purpose for which it was taken : And whereas compensation in respect of the taking of the said land has not been paid or awarded : Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf,*do hereby revoke the said Proclamation.
Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty's Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this twenty-third day of August, in the year of our Lord one thousand nine hundred and thirteen.

Amending Order in Council establishing Cook and other Islands Land Titles Court.
LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of August, 1913.
Present :
His Excellency the Governor in Council.
WHEREAS by Order in Council made on the seventh day of July, one thousand nine hundred and two, under the powers in that behalf conferred upon the Governor in Council by the Cook and other Islands Government Act, 1901, and its amendments, the Cook and other Islands Land Titles Court (hereinafter called "the said Court") was established, with the power and functions in the said Order in Council mentioned : And whereas it is expedient to amend the said Order in Council in manner bereinafter appearing : Now, therefore, in exercise of the power conferred upon him by the Cook Islands Government Act, 1908, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke clause three of the said Order in Council, and doth hereby order that the following clause shall be substituted in lieu thereof :β€” "3. The Court shall consist of one Judge, to be appointed by the Governor in Council, who shall be called the Chief Judge of the said Court, and of such other Judges as the Governor from time to time appoints. There shall be also such Registrars, Deputy Registrars, Clerks, Interpreters, and other officers as may be required for the conduct of the business of the Court, and as may be appointed by the Governor in Council under the provisions of the said Act."

Arrangements for taking Poll respecting Proposed Alteration of Boundaries of City of Auckland.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fifth day of August, 1913.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by the Municipal Corporations Amendment Act, 1910, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct that a poll shall be taken on the proposal praying that the area described in the Schedule hereto, being the Eden Terrace Road District, County of Eden, may be added to the City of Auckland ; and, further, doth hereby make the following appointments and arrangements for the purpose of taking the said poll :β€” 1. Percival Stanley Ussher, of Auckland, to be the Returning Officer for the purpose of taking the said poll, and also to be the person authorized to prepare a voters roll of the persons entitled to vote at the said poll.
2. The voters roll prepared and signed by the said Percival Stanley Ussher shall be the voters roll to be used at the said poll.
3. Each person on such roll shall be entitled to one vote only.
4. The said poll shall be taken on Saturday, the thirteenth day of September, one thousand nine hundred and thirteen, and shall close at seven o'clock in the afternoon of that day.
5. Except as herein provided, the said poll shall be taken as nearly as may be in the manner provided by the Local Elections and Polls Act, 1908, and the Returning Officer hereby appointed shall be deemed to be a Returning Officer appointed for the purposes of that Act.
SCHEDULE.
AREA PROPOSED TO BE ADDED TO THE CITY OF AUCKLAND.
ALL that area in the Auckland Land District bounded towards the north-west and north-east by the City of Auckland from the northernmost corner of the Borough of Mount Albert to the northern boundary of the Borough of Mount Eden, thence towards the south-east generally by the Borough of Mount Eden to the eastern boundary of the Borough of Mount Albert, and thence towards the south-west by the Borough of Mount Albert to the southern boundary of the City of Auckland, the place of commencement.

Consenting to stopping Roads in Block XIII, Rolleston Survey District, Malvern County.
LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fifth day of August, 1913.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section one hundred and thirty-three (a, of the Public Works Act, 1908, it is enacted that a local authority shall not declare any county road or district road to be stopped until the consent thereto of the Governor by Order in Council gazetted is obtained : And whereas the Malvern County Council has applied for such consent in respect of the roads described in the Schedule hereto : Now, therefore, in pursuance and exercise of the above-in -part- recited Act, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Malvern County Council stopping the roads described in the Schedule hereto.
