writing, require it within thirty days to remedy the default
specified in that notice; but the Council shall not be held
to have committed default for any failure to maintain power
continuously if such failure is due to the breakdown of
machinery or other accident, unless such breakdown or
accident is proved to be due to negligence on the part of
the said Council; and if the Council fails to comply with the
terms of the said notice within the said period, it shall be
liable to a penalty of Β£20, to be recoverable by or on behalf
of the Minister as a debt due to the Crown. The recovery
of a penalty under this license shall not affect the liability
(if any) of the Council to pay or make compensation in respect
of any damage or injury which may be caused by reason
of the default.

  1. Notwithstanding anything in the last preceding clause
    of these conditions, if the said Council fails to comply with
    the terms of any such notice for ninety days after the receipt
    thereof, the Governor in Council may thereupon revoke this
    license without further notice.

  2. For the purpose of ascertaining whether the con-
    ditions of this license are being faithfully complied with by
    the said Council, the Minister, or any person appointed by
    him in that behalf, may at all reasonable times enter on
    the lands and works and inspect the same.

  3. Nothing in this license shall be deemed in any way to
    interfere with, affect, or abridge any rights or powers vested
    in His Majesty the King, or in the Governor on his behalf,
    authorizing the construction, management, or working of
    any public works; nor shall any compensation be payable
    to or on behalf of the said Council for injury done to the
    works herein authorized by the construction, management,
    or working of any such public work as aforesaid, or for the
    loss occasioned thereby, or for the exercise of any such right
    or power as aforesaid.

  4. Notwithstanding anything hereinbefore contained, the
    said Council shall not be entitled to erect, maintain, or use
    any electric line within the Thames County except subject to
    such conditions, not inconsistent with the provisions of this
    license, as may from time to time be agreed on between the
    said Council and the Thames County Council.

Consenting to closing a Road in Block II, Heretaunga Survey
District, Hawke's Bay County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twentieth day
of January, 1913.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section one hundred and thirty-three
(a) of the Public Works Act, 1908, it is enacted
that a local authority shall not declare any county road
or district road to be stopped until the consent thereto of
the Governor by Order in Council gazetted is obtained:

And whereas the Hawke's Bay County Council has
applied for such consent in respect to the road described in
the Schedule hereto:

Now, therefore, in pursuance and exercise of the above-
in-part-recited Act, and of all other powers in anywise en-
ableing him in this behalf, His Excellency the Governor of
the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said
Dominion, doth hereby consent to the Hawke's Bay County
Council closing the road described in the Schedule hereto.

Declaring Clover Road in the Tauranga County to be a County Road.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twentieth day
of January, 1913.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers vested in him by
the Public Works Act, 1908, and of all other powers in
anywise enabling him in this behalf, His Excellency the Go-
vernor of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby order and declare that the portion of
road described in the Schedule hereto shall, on and after the
date of this Order in Council, become a county road.

SCHEDULE.

ALL that portion of road in the Tauranga County, Auckland
Land District, known as the Clover Road, commencing at
its junction with the Omanawa Road at the boundary be-
tween Sections 2 and 4, Block XI, Otanewainuku Survey
District, and running in a north-westerly direction generally
along the frontages of Sections 2 and 3, and terminating at
the north-western corner of the said Section 3, all in Block XI,
Otanewainuku Survey District, being a distance of 68 chains,
more or less; as the said portion of road is more particularly
delineated on the plan marked P.W.D. 32829, deposited in
the office of the Minister of Public Works, at Wellington, in
the Wellington Provincial District, and thereon coloured red.

Declaring Portion of Omanawa Road in the Tauranga County
to be a County Road.

date of this Order in Council, become a county road.

ALL that portion of road in the Auckland Land District,
Tauranga County, known as Omanawa Road, commencing at
its junction with the Tauranga-Rotorua Road, at the south-
east corner of Section 1, Block XI, Otanewainuku Survey
District, and running in a north-westerly direction generally
along the southern boundaries of Sections 1, 2, and 4, Block
XI, Otanewainuku Survey District, and between parts of
Sections 4 and 1, Block X, Otanewainuku Survey District,
and terminating at the northernmost corner of Section 4,
Block X, Otanewainuku Survey District, being a distance of
2 miles 75 chains, more or less; as the said road is more
particularly delineated on the plan marked P.W.D. 32828,
deposited in the office of the Minister of Public Works, at
Wellington, in the Wellington Provincial District, and thereon
coloured red.
