Regulations under the Prisons Act, 1908.
LIVERPOOL, Governor.
A PROCLAMATION.
WHEREAS it is enacted by section eight of the Prisons Act, 1908 (hereinafter referred to as the said Act) that the Governor may from time to time by Proclamation make regulations prescribing:—
(a.) The duties of the officers of prisons;
(b.) The construction and description of cells for separate confinement or punishment of persons confined in prisons, and the certifying the same as fit for the purpose;
(c.) The safe custody, the classification, hours of labour, mode of employment, separation, diet, instruction, treatment, and correction of the prisoners confined in prisons;
(d.) The employment, safe custody, management, and discipline of prisoners under sentence of penal servitude or of imprisonment for a term of three years or upwards;
(e.) What labour or employment shall be deemed hard labour, and for classifying such labour;
(f.) The remission of portions of sentences by marks to be earned by the good conduct of the prisoners;
(g.) Any other purpose or object for which by the said Act it is provided that regulations, either general or special, may be made;
(h.) Generally all such regulations as are necessary for the good management and government of such prisons, and the discipline and safe custody of the prisoners therein, and not only while therein, but also while employed at labour beyond the limits of the prison:
Now, therefore, in pursuance and exercise of the powers so conferred upon me by the said section, and of all other powers enabling me in that behalf, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby revoke, as from the first day of February, one thousand nine hundred and thirteen, the following regulations, namely:—
(a.) Regulations made under the Prisons Act, 1882, and published in the Gazette of the twenty-ninth day of November, one thousand eight hundred and eighty-three, at page 1681; and
(b.) Regulations made under the Prisons Act, 1882, and published in the Gazette of the twenty-ninth day of March, one thousand nine hundred, at page 633,—
and do hereby make in lieu thereof the regulations hereinafter set forth, and do hereby declare that the said regulations shall come into force on the said first day of February, one thousand nine hundred and thirteen.

REGULATIONS.
INTERPRETATION.
- IN these regulations—
“Minister” means the Minister of Justice.
“Under-Secretary” means the Under-Secretary for Justice, Wellington.
“Inspector” means the Inspector of Prisons appointed under the said Act.
“Deputy Inspector” means the Deputy Inspector of Prisons appointed under the Prisons Amendment Act, 1912.
“Medical Officer” of any prison means the surgeon appointed to that prison under section 5 of the said Act.
APPLICATION.
- If it appears to the Minister that the provisions of these regulations are not wholly applicable to any particular prison he may, in their application to the said prison, make such modifications thereof as he thinks fit.
ADMINISTRATIVE.
Inspector.

The Inspector shall from time to time visit the different prisons of the Dominion, and shall endeavour to ensure by personal inspection that the rules and regulations are duly enforced and that the discipline of the prisons is properly maintained.

He shall make inquiry into any matter relating to the conduct of any prison or the administration of the said Act that may from time to time be specially referred to him by the Minister.

He shall, subject to the confirmation of the Minister, have power to suspend, fine, or stop the pay of any officer of the prison service; and any departmental orders he may issue shall be strictly carried out.

He shall from time to time inspect the stores, and shall ascertain that the rations, clothing, and utensils are of good quality and fit for the purposes for which they are severally required.

He shall inspect the books and accounts of each prison, and shall be responsible that they are properly and efficiently kept.

He shall have access to all parts of the prison, and shall from time to time visit the works where prisoners may be employed, and shall see that suitable employment is given to the prisoners and that the marks are fairly allotted.
