ORDER IN COUNCIL.
At the Government House, at Wellington, this twelfth day of April, 1913.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS, in accordance with the provisions of the third section of the Land Drainage Act, 1908, a majority of the ratepayers in the area of land described in the Schedule hereto, situated in the County of Waikato, have presented a petition to His Excellency the Governor of the Dominion of New Zealand, praying that the said area be constituted a drainage district under the provisions of the said Act:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority contained in the third section of the Land Drainage Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the area of land described in the Schedule hereto to be a district for the purposes of Part I of the said Act, and to be called by the name of the “Uapoto Drainage District”; and also, in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees of the said district shall consist of five persons, to be elected as members of the said Board, and under and in accordance with the said Act.
SCHEDULE.
UAPOTO DRAINAGE DISTRICT.
All that area in the Auckland Land District, containing about 2,630 acres, situate in Block XIII, Hapuakohe Survey District, and Blocks I and II, Komakorau Survey District. Bounded towards the north-east by a line running parallel to and distant 50 chains north-easterly from a base-line, hereinafter described, which runs through the middle of the drainage district from the road which forms the north-western boundary of Section No. 163, Taupiri Parish, in Block XIII aforesaid, to a point bearing 45° 18′, and distant 5000 links, from peg No. IX on plan No. 4791A, in the office of the District Land Registrar at Auckland; thence towards the south-east by a right line to the said peg No. IX and the south-eastern boundary of the land shown on plan No. 4791A aforesaid; towards the south-west by a line parallel to and distant 50 chains south-westerly from the base-line aforesaid; and towards the north-west by the north-western boundaries of the land comprised in certificates of title, Vol. 145, folio 6, and Vol. 149, folio 215, Register-book, in the office of the District Land Registrar at Auckland; excluding the north-eastern corner of Section No. 468, Taupiri Parish, in Block XIII aforesaid. The aforesaid base-line commences at peg No. IX on plan No. 4791A aforesaid, and runs north-westerly, bearing 315° 15′, distance 8310 links, to peg No. VIII; thence bearing 316° 12′, distance 2058·6 links, to peg No. LXI; thence bearing 316° 9′ 30″, distance 10936·4 links, to peg No. XII; and thence bearing 316° 47′, distance 4587·2 links, to the north-western boundary of the drainage district.

Validating Proceedings in connection with the Taumarunui Borough Council Special Loan of £4,500.

At the Government Buildings, at Wellington, this fifteenth day of April, 1913.

WHEREAS the Taumarunui Borough Council lately proposed to raise a loan of four thousand five hundred pounds under the Local Bodies’ Loans Act, 1908, and its amendments, for the installation of street and house lighting by means of “Dreadnought gas” in the Borough of Taumarunui: And whereas an irregularity or defect has occurred in the procedure to obtain such loan inasmuch as the newspaper notice required to be given by paragraph (d) of section three of the Local Bodies’ Loans Act, 1908, with reference to the deposit for public inspection of the special roll prepared in connection with the raising of such loan did not state that the area described as “Subdivisions 1 to 27 (inclusive), Ohura South G No. 4p, known as Ngatai’s Extension,” was included in the part of the borough over which the loan was to be raised, although such special roll did include that area, and the said area was definitely described in all subsequent proceedings relating to the loan: And whereas it appears that the ratepayers have not been misled by such irregularity or defect:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and section seven of the Local Bodies’ Loans Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said public notification of the said special roll, and doth hereby order and declare that the proceedings adopted to raise the said loan shall be taken to be as valid as though the said public notification had correctly described the area affected by the said special roll. And His Excellency the Governor, with such advice and consent as aforesaid, doth further order and declare that the proceedings in connection with the said loan shall not be called in question by reason only of the irregularity or defect aforesaid.

At the Government Buildings, at Wellington, this fifteenth day of April, 1913.

THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.
WHEREAS by section four of the Fire Brigades Act, 1908 (hereinafter termed “the said Act”), it is provided that the Governor may by Order in Council, on the application of any Borough Council, declare the district within the jurisdiction of such Borough Council to be a fire district under the said Act: And whereas an application has been made by the Timaru Borough Council in accordance with the provisions of the said Act, and it appears expedient to grant the said application:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare the Borough of Timaru to be a fire district under the said Act.
