purpose to which such reserve or such land acquired in exchange shall be dedicated: And whereas, in the opinion of the Governor, it is expedient to exchange the said reserve for roadmen’s huts for other land of equal value, described in Part II of the Schedule hereto, to be dedicated as hereinafter provided:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities vested in him by section four of the said Act, doth hereby declare that the reserve for a site for roadmen’s huts described in Part I of the Schedule hereto is hereby exchanged for the Crown land described in Part II of the Schedule hereto, which, in the opinion of the Governor, is of equal value; and doth also declare that the land described in the said Part I becomes and is Crown land freed from all previous reservation and subject to the provisions of the Land Act, 1908, and that the land described in the said Part II is hereby reserved as a site for roadmen’s huts, being one of the purposes comprised in the said Class I.

PART I.
Description of Reserve exchanged.
ALL that area in the Wellington Land District, containing by admeasurement 2 acres 1 rood 2 perches, more or less, being Section 11, Pukeroa Village. Bounded towards the north-east by a public road, 683 links; towards the south-east by Sections 6 and 7, 276 links and 293·3 links; towards the south-west generally by the Turakina Valley Road, 574·3 links and 160 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 460/21A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.
PART II.
Description of Land obtained in Exchange therefor.
All that area in the Wellington Land District, containing by admeasurement 1 acre 3 roods 35 perches, more or less, being Section 16, Block XII, Mangawhero Survey District. Bounded towards the north-east by a public road, 677 links and 315·5 links; towards the south-east by Section 15, 284·5 links; and towards the south-west by Section 12, 854 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 460/21B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.

Exchanging a Reserve in the Village of Pukeroa, Wellington Land District, for other Land.

WHEREAS the land described in Part I of the Schedule hereto was heretofore duly set apart for gravel purposes, being a reserve within Class I of the Second Schedule to the Public Reserves and Domains Act, 1908 (hereinafter referred to as “the said Act”): And whereas by section four of the said Act the Governor is authorized, inter alia, to exchange any such reserve for other land of equal value, to be dedicated to the same or one or more of the purposes comprised in the said Class I, and to define the purpose to which such reserve or such land acquired in exchange shall be dedicated: And whereas, in the opinion of the Governor, it is expedient to exchange the said gravel reserve for other land of equal value, described in Part II of the Schedule hereto, to be dedicated as hereinafter provided:

Description of Land obtained in exchange therefor.
All that area in the Wellington Land District, containing by admeasurement 1 acre 1 rood 27 perches, more or less, being Section 15, Block XII, Mangawhero Survey District. Bounded towards the north-west by Section 16, 284·5 links; towards the north-east and south-east generally by a road and riverbank reserve, 218·3 links and 610 links, along the western bank of the Turakina River; and towards the south and south-west by Section 19, 345 links, and Section 12, 264·9 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 460/21B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Exempting Railway Reserve Road, in the Borough of Gisborne, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eighteenth day of November, 1912.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where a local authority having control of a road or street declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council: And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas the Gisborne Borough Council, the local authority having control of the street described in the Schedule hereto, did, on the third day of September, one thousand nine hundred and twelve, by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street: And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street.
