Declaring Native Land to be subject to Part XVI of the Native Land Act, 1909.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighteenth day of November, 1912.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section three hundred and fifty-three of the Native Land Act, 1909 (hereinafter referred to as “the said Act”), it is enacted that, on the confirmation of any such resolution as is referred to in paragraph (c) of section three hundred and forty-six of that Act, the Governor may, if he thinks fit, by Order in Council declare that the land affected by the resolution shall be subject to Part XVI of that Act as from the date of the Order in Council; and the land shall thereupon, and at all times thereafter while the Order in Council remains in force, remain subject to that Part of that Act accordingly, and all the provisions thereof shall apply in the same manner as if the land was subject to that Part of that Act by virtue of an Order in Council made under the authority thereof:

And whereas by a resolution within the said paragraph (c) of the said section three hundred and forty-six, passed by the assembled owners and duly confirmed by the Tairawhiti District Maori Land Board, it was resolved that the blocks or parcels of land particularized and set out in the Schedule hereto be leased by the said Board under Part XVI of the said Act: And whereas it is expedient that the said lands should be declared subject to Part XVI of the said Act:

Now, therefore, in pursuance and exercise of the powers in this behalf vested in him by the aforesaid section three hundred and fifty-three, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the blocks or parcels of land described in the Schedule hereto shall be subject to Part XVI of the Native Land Act, 1909, as from the date of this Order in Council. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

SCHEDULE.

ALL that piece or parcel of land situate in the Tokomaru Survey District, containing 441 acres 3 roods 20 perches, more or less, known as Marahea Block, and bounded on the west by the Karoronui Stream and the Taumatapatiti No. 3 Block, on the north by the Nuhihi No. 1 Block and the Waioe Block, and on the east and south-east by the Pacific Ocean.

All that piece or parcel of land situate in the Tokomaru Survey District, containing 3,760 acres 3 roods 5 perches, more or less, known as Nuhihi No. 1 Block, and bounded on the south and south-west by the Waioue, Marahea, Taumatapatiti No. 3, and Taumatapatiti Blocks; on the west by the Tokomaru L and 3G Blocks; on the north-east and east by the Tokomaru B 5 and 10 Blocks, Waihoa No. 1, Nuhihi No. 2, and Tangoiro Blocks; and on the east by the Pacific Ocean.

All that piece or parcel of land situate in the Tokomaru Survey District, containing 340 acres 1 rood 22 perches, more or less, known as Nuhihi No. 2 Block, and bounded on the north-east and east by the Wairoa Stream, the Mawhai Block, and the Pacific Ocean; on the north-west and south-west by the Waihoa No. 1, Nuhihi No. 1, and Tangoiro Blocks; and on the east by the Pacific Ocean.

All that piece or parcel of land situate in the Tokomaru Survey District, containing 348 acres 1 rood 20 perches, more or less, known as Tangoiro Block, and bounded on the south-west and north-west by the Nuhihi No. 1 Block, on the north-east by the Nuhihi No. 2 Block, and on the south-east by the Pacific Ocean.

All that piece or parcel of land situate in the Tokomaru Survey District, containing 142 acres and 22 perches, more or less, known as Waioue Block, and bounded on the south by the Marahea Block, on the north-west and north by the Nuhihi No. 1 Block, and on the east by the Pacific Ocean.

At the Government Buildings, at Wellington, this eleventh day of November, 1912.

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

IN pursuance and exercise of the power and authority conferred by the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke a certain Order in Council, dated the twentieth day of November, one thousand nine hundred and eleven, appointing a Domain Board to have control of the Mount Albert Domain, and doth hereby appoint

THE MOUNT ALBERT BOROUGH COUNCIL

to be the Mount Albert Domain Board, having the control of the lands described in the Schedule hereto for the purposes of and subject to the provisions of Part II of the said Act; and doth hereby appoint Monday, the ninth day of December, one thousand nine hundred and twelve, at seven o’clock p.m., as the time when, and the Mount Albert Borough Council Chambers, New North Road, Morningside, as the place where, the first meeting of the said Board shall be held.

SCHEDULE.

MOUNT ALBERT DOMAIN.

ALL that area in the Auckland Land District, being part of Allotment No. 100 of the Parish of Titirangi, containing by admeasurement 12 acres 2 roods 12 perches, more or less. Bounded towards the north-east by Lot No. 96 of the Parish of Titirangi, 908·4 links; towards the south-east by Lot No. 95 of the aforesaid parish, 1072·4 links; towards the south-west by Lot No. 54 of the aforesaid parish, 1652 links; towards the north-west by Lot No. 98 of the aforesaid parish, the abutment of a public road, and again by the aforesaid lot, 1220 links; towards the north by Lot No. 97 of the aforesaid parish, 785 links; towards the south-east generally by other part of Lot No. 100 of the aforesaid parish, 108, 434·1, 230·6, and 362·1 links respectively; towards the north-east generally by other part of Lot No. 100 aforesaid, 764·3, 150, and 329·4 links respectively; towards the north-west generally by other part of Lot No. 100 aforesaid, 264·4, 500, 690, and 107·8 links respectively: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 1490, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Also all that area in the Auckland Land District, containing by admeasurement 29 acres 2 roods, more or less, being Allotments 176 and 177 of Section 10, Suburbs of Auckland, Parish of Waitemata. Bounded towards the north-east by a public road 100 links wide; towards the south-east by Allotment 170 of Section 10, Suburbs of Auckland; towards the south-west by Allotment 171 of Section 10 aforesaid; and towards the north-west by a public road 100 links wide: as the same is delineated on the plan marked L. 1402/20A, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red. WHEREAS the land described in Part I of the Schedule hereto was heretofore duly set apart as a site for roadmen’s huts, being a reserve within Class I of the Second Schedule to the Public Reserves and Domains Act, 1908 (hereinafter referred to as “the said Act”): And whereas by section four of the said Act the Governor is authorized, inter alia, to exchange any such reserve for other land of equal value, to be dedicated to the same or one or more of the purposes comprised in the said Class I, and to define the
