Preference.

  1. The employers shall employ members of the union in preference to non-members, provided there are members of the union equally qualified with non-members to perform the particular work required to be done, and known to the employer to be available in the locality where the employer’s business is situated, and who are ready and willing to undertake the work when non-members are employed.

Time Statement.

  1. (a.) The time statement hereto attached shall be deemed to be incorporated herein, and shall form part of this award.
    (b.) When other than weekly hands are employed at ladies’ tailoring, the work may be done, at the option of the employer, either at log rates or at the minimum rate of 1s. 4½d. per hour by the clock.

Detailed Disputes.

  1. In case of a dispute as to the interpretation of any of the clauses or provisions hereof, or of anything in the time statement, such dispute shall be referred to a joint committee, consisting of two representatives of the union and two of the employers, to be appointed as occasion requires, such representatives to elect a chairman, who shall have a casting-vote, and in default of their agreeing upon a chairman, the chairman shall be the Conciliation Commissioner or the Inspector of Factories for the district. The interpretation adopted by such committee shall be deemed the proper interpretation of the award subject to any ruling of the Court.

Strikes.

  1. (a.) The union shall do all in its power to prevent any strike by any of the workers affected by this award, and if any strike shall occur in which any members of the union shall take part such strike shall be prima facie evidence that the union has committed a breach of its duty hereunder.
    (b.) If any strike by any of the workers affected by this award shall occur in which any members of the union shall take part, then the operation of all the provisions contained in the foregoing clauses of this award shall be suspended, and in lieu thereof the following provisions shall come into force, and shall remain in force until the further order of this Court, that is to say—
    The hours of work, wages, and other conditions of work of all workers coming within the scope of this award shall be fixed by agreement between the employer and the individual workers employed by him.
    (c.) The Court reserves leave to any party bound by this award to apply to this Court for an order under this clause declaring that a strike has taken place, or bringing into force again after a strike has taken place the provisions contained in the foregoing clauses of this award.

TIME STATEMENT.

CLASSIFICATION OF MATERIAL.

The time hereinafter mentioned shall be calculated at the rate of 1s. per hour.

First Class.

Superfine cloth, beavers, Venetian, face covert coating, kersey, buckskin, doeskin, satura, llamas, heavy Meltons, dress coatings, velvet, velveteen, velvet cord, Bedford cord, whipcord, dress worsted coatings, corkscrews, heavy pilots, plush, silk, satin, quilting, cassimere, fur, knitted vests, faced hunting vesting, marcella; box-cloth, silk vesting, fancy vesting, and all other faced cloths.

Second Class.

Fancy or worsted coatings and worsted suitings, worsted trousering, very light quality Melton (any colour), nap, whitneys, friezes, unfaced covert coatings, silk mixture, vicuna, heavy milled serge, worsted silk mixture, angola, Saxony, fine serge, stockinette, light-quality pilots (any colour), fine hopsack, heavy hopsack, very light quality beaver (any colour), fine bellwarp coatings or serge, heavy bellwarp coatings or serge, camel-hair, sergerettes, alpaca, and lustre. Horse-cloth fancy vestings, Valencia Russell cord, Valencia white drill.

Third Class.

Common rough inferior worsted suitings, common rough inferior segerettes, cotton, corduroy, moleskin, drills, ducks, khaki, or jean. Common rough inferior, serges, Harris and homespun tweeds, Bannockburns, tennis or cricket flannel, saddle tweed,* tweeds and other material not mentioned in the other classes.
