to such conditions as the Governor, by Order in Council,
thinks fit to impose :

And whereas the Grey Lynn Borough Council, the local
authority having control of the streets described in the Sche-
dule hereto, did by resolution declare that the provisions of
the said section one hundred and seventeen should not apply
to the said streets : And whereas it is deemed expedient
that such resolution should be approved, subject to the con-
dition hereinafter mentioned :

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by the above-in-part-recited Act, and acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the said resolu-
tion, subject to the condition that no building or part of a
building shall at any time be erected on either side of the
said streets within a distance of twenty-five feet from the
centre-line of the said streets.

SCHEDULE.

ALL that street in the Borough of Grey Lynn, known as Peel
Street, commencing at its junction with King Street, and
running in a south-westerly direction to its junction with
Warnock Street, being a distance of 11 chains, more or less.

Also all that street in the Borough of Grey Lynn, known
as Princes Street, commencing at the southern bank of Cox’s
Creek, and running in a south-westerly direction, intersecting
Queen Street and King Street, and terminating at a point
24½ chains from its point of commencement.

Also all that street in the Borough of Grey Lynn, known
as Victoria Street, commencing at the southern bank of Cox’s
Creek, and proceeding in a south-westerly direction, inter-
secting Queen Street and King Street, and terminating at a
point 17½ chains, more or less, from its point of commence-
ment.

As the said streets are more particularly delineated on the
plan marked P.W.D. 31471, deposited in the office of the
Minister of Public Works, at Wellington, in the Wellington
Provincial District, and thereon coloured red.

Exempting Eldin Street, in the Anderson’s Bay District, from
the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
first day of October, 1912.

Present :

THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908, it is,
inter alia, provided that the said section shall not apply in
any case where a local authority having control of a road or
street by resolution declares that the provisions thereof shall
not apply to any specified road or street, or any specified
part thereof, and such resolution is approved by the Governor
in Council :

And whereas on the fifth day of August, one thousand nine
hundred and twelve, the Bay Town Board, the local autho-
rity having control of the road described in the Schedule
hereto, did by resolution declare that the provisions of the
said section one hundred and seventeen should not apply to
the said road :

And whereas it is deemed expedient that such resolution
should be approved :

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by the above-in-part-recited Act, and acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the said reso-
lution in so far as it effects the said road described in the
Schedule hereto.

SCHEDULE.

ALL that road situated in the Otago Land District, Bay Town
District, known as Eldin Street, passing through Sections 1
and 128B, Block II, Anderson’s Bay District; as the said
road is more particularly delineated on the plan marked
P.W.D. 32539, deposited in the office of the Minister of Public
Works, at Wellington, in the Wellington Provincial District,
and thereon bordered red.

Exempting the South Side of Christie Street, Portions of the
South-western Side of Seaton Road, the North-western and
South-eastern Sides of Beaconsfield and McAulay Roads,
and the North-eastern Side of McGeorge Street, in the Town-
ship of Seaton, Portobello Road District, from the Provi-
sions of Section 117 of the Public Works Act, 1908, subject
to certain Conditions as to the Building-line.

And whereas by subsection two of section one hundred and
seventeen of the Public Works Act, 1908, and clause (b) of
subsection one of section thirteen of the Public Works Amend-
ment Act, 1911, it is provided that such approval may be
either absolute or subject to such conditions as the Governor
in Council thinks fit to impose, and may refer to one of both
sides of the road or street :

And whereas the Portobello Road Board, the local autho-
rity having control of the portions of roads described in the
Schedule hereto, did on the second day of May, one thousand
nine hundred and twelve, by resolution declare that the pro-
visions of the said section one hundred and seventeen should
not apply to the said roads :

And whereas it is deemed expedient that such resolution
should be approved in so far as it refers to the south side of
Christie Street, portions of the south-western side of Seaton
Road, the north-western and south-eastern sides of Beacons-
field and McAulay Roads, and the north-eastern side of
McGeorge Street, as described in the said Schedule, subject
to the conditions hereinafter mentioned :

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by the above-in-part-recited Act, and acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the said reso-
lution to the extent mentioned in the last preceding para-
graph hereof, subject to the condition that no building or
part of a building shall be erected at any time within thirty-
three feet of the centre-line on the south side of Christie
Street, portions of the south-western side of Seaton Road,
the north-western and south-eastern sides of Beaconsfield
and McAulay Roads, and the north-eastern side of McGeorge
Street, as described in the Schedule hereto, provided that this
condition shall not apply to Subdivision 208 of Section 4 and
Subdivision 217 of Section 5, Block VII, Portobello District.

ALL that road known as Christie Street, situated in the Otago
Land District, Township of Seaton, fronting Subdivisions 222,
223, 224, 225, and 208 of Sections 5 and 4, Block VII, Porto-
bello District.

Also all that portion of Seaton Road, situated in the said
land district and township, fronting Subdivisions 208, 209,
210, and 211 of Section 4, Block VII, Portobello District.

Also all that portion of Beaconsfield Road, situated in the
said land district and township, fronting Subdivisions 211,
212, 213, 214, 215, 216, and 217 of Sections 4 and 5, Block VII,
Portobello District.

Also all that portion of Beaconsfield Road, situated in the
said land district and township, and fronting Subdivisions 101,
102, 103, and 104 of Section 2, Block VII, Portobello District.

Also all that portion of McAulay Road, situated in the said
land district and township, fronting Subdivisions 75, 76, 77,
78, 79, 80, 81, 82, 95, 96, 97, 98, and 99 of Sections 2 and 3,
Block VII, Portobello District.

Also all that portion of McGeorge Street, situated in the
said land district and township, fronting Subdivisions 99, 100,
and 101 of Sections 3 and 2, Block VII, Portobello District.

As the said portions of roads are more particularly de-
lineated on the plan marked P.W.D. 31177, deposited in the
office of the Minister of Public Works, at Wellington, in the
Wellington Provincial District, and thereon coloured red.
