Exempting Portion of District Road, in the Bay Town District, from the Provisions of Section 117 of the Public Works Act, 1908.

ISLINGTON, Governor.
ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of June, 1912.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor, by Order in Council, thinks fit to impose :

And whereas the Bay Town Board, being the local authority having control of the portion of road described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portion of road :

And whereas it is deemed expedient that such resolution should be approved :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it affects the portion of road described in the Schedule hereto.

SCHEDULE.

ALL that portion of road in the Bay Town District, known as District Road, adjoining Section 8, Block I, Anderson’s Bay District, having a length of 4¼ chains, more or less; as the said portion of road is more particularly delineated on the plan marked P.W.D. 31792, deposited in the office of the Minister of Public Works, at Wellington, in the Provincial District of Wellington, and thereon coloured red.

Exempting Portions of Earl and Princes Streets in the Borough of Green Island from the Provisions of Section 117 of the Public Works Act, 1908.

At the Government House, at Wellington, this twenty-fourth day of June, 1912.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where a local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas on the first day of May, one thousand nine hundred and twelve, the Green Island Borough Council, the local authority having control of the portions of streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portions of streets :

And whereas it is deemed expedient that such resolution should be approved :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it affects the said portions of streets described in the Schedule hereto.

SCHEDULE.

ALL that portion of street in the Otago Land District, Lower Kaikorai District, Green Island Borough, known as Earl Street, commencing at its junction with Princes Street, and proceeding thence in a northerly direction for a distance of 2 chains 20 links, more or less.

Also all that portion of street in the Otago Land District, Lower Kaikorai District, Green Island Borough, known as Princes Street, commencing at its junction with Earl Street, and proceeding thence in a westerly direction to its junction with the Kaikorai Stream, being a distance of 2 chains 90 links, more or less.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 31702, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Exempting Portions of Crown and William Streets, in the Borough of Balclutha, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of June, 1912.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or to any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor in Council thinks fit to impose :

And whereas the Balclutha Borough Council, the local authority having control of the portions of streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portions of streets :

And whereas it is deemed expedient that such resolution should be approved :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said portions of streets within a distance of thirty-three feet from the centre-line of the said portions of streets.

SCHEDULE.

ALL that portion of Crown Street, situated in the Otago Land District, Borough of Balclutha, fronting Allotments 1 and 2, Block II, J. McNeil’s subdivision of Sections 4 and 5, Block XXXV, Clutha District.

Also all that portion of William Street, situated in the said land district and borough, fronting Allotment 1, Block II, J. McNeil’s subdivision of Sections 4 and 5, Block XXXV, Clutha District.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 31820, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red and blue respectively.
