Notice of Intention to change the Purpose of Portion of a Reserve in the Marlborough Land District.

ISLINGTON, Governor.

WHEREAS by the Public Reserves and Domains Act, 1908, it is, amongst other things, enacted that the Governor may declare his intention to change, exchange, or alter the dedication of any public reserve now or hereafter vested in His Majesty or the Governor for any of the purposes named in Class II of the Second Schedule to the said Act, whether the same be granted or not; and in the case of any reserve made under the authority of section three hundred and twenty-one of the Land Act, 1908, if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserve or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, or if it shall, in the opinion of the Governor, be expedient to exchange any of the land comprised in such reserve for other land of equal value, to be dedicated to one or more of the purposes named in the said Class II, the Governor may, by notice gazetted, make such change, exchange, or dedication, as the case may be, and in such notice declare the manner and terms in which the same is intended to be so made:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, do hereby, in pursuance and exercise of the powers and authorities vested in me by the Public Reserves and Domains Act, 1908, aforesaid, declare my intention to change the specific purpose of the portion of the reserve described in Part II of the Schedule hereto from that named in Part I of the said Schedule to that named in Part III of the said Schedule.

SCHEDULE.

PART I.

Description and Purpose of Original Reserve.

All that area in the Marlborough Land District, containing by admeasurement 40 acres, more or less, situated in Block XII, Linkwater Survey District, adjoining the Town of Picton, and being Section 55, Picton Suburban. Bounded towards the north-west and north-east by Crown land; towards the east generally by Picton Town Sections Nos. 997 and 999 and a public road; and towards the south-west by section numbered 12, Picton Suburban: as the same is delineated on the plan marked L. 5330/6, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Set apart as a reserve for timber by notification in Marlborough Provincial Gazette No. 88, of the 22nd December, 1864, and granted to the Superintendent of Marlborough on the 27th January, 1866, for the purpose of supplying timber for the public service.

PART II.

Description of Portion of Reserve the Purpose of which it is intended to change.

All that area in the Marlborough Land District, containing by admeasurement 10 acres 2 roods 14 perches, more or less, being part of Section 55, Picton Suburban, situated in Block XII, Linkwater Survey District. Bounded towards the north-east by part Section 55, 563·2 links; towards the south-east by a public road, 192·1 links, 325·5 links, 224·7 links, and 739·5 links; towards the south-west by Section 12, Block XII, Linkwater Survey District, 769·5 links; and towards the north-west by part of Section 55, 1500 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 5330/4, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

PART III.

Intended Purpose.

For railway purposes.

As witness the hand of His Excellency the Governor, this twenty-first day of December, one thousand nine hundred and eleven.

Declaring Land in the Wellington Land District to be subject to the Land for Settlements Act, 1908.

ISLINGTON, Governor

IN pursuance and exercise of the powers conferred by section seventy-nine of the Land for Settlements Act, 1908, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, do hereby declare that the area of Crown land described in the Schedule hereto shall be subject to the provisions of the Land for Settlements Act, 1908, and shall hereafter form part of the Longbush Settlement.

SCHEDULE.

All that area in the Wellington Land District, containing by admeasurement 1 acre 1 rood 34 perches, more or less, being portion of a road closed by Proclamation in the New Zealand Gazette No. 52, page 2042, of the 29th June, 1911, situated in Block VIII, Huararua Survey District, commencing at a point 37·7 links distant and on a bearing of 23° 52′ from the western angle peg of traverse No. XX on the Wangaehu Road; thence by a line bearing 270° 4′ for a distance of 1498 links to the Wangaehu Stream; thence in a southerly direction by that stream for a distance of 108 links; thence by a line bearing 90° 4′ for a distance of 1427·9 links to the Wangaehu Road; thence by a line bearing 12° 10′ for a distance of 66·9 links to the place of commencement: as the same is delineated on the plan marked L. 19264/164, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured red.

As witness the hand of His Excellency the Governor, this twentieth day of January, one thousand nine hundred and twelve.

Warrant authorizing the Oroua County Council to construct a Bridge over the Oroua River, at Menzies Ford, together with the Approaches thereto and Protective Works, and apportioning the Cost.

ISLINGTON, Governor.

WHEREAS by section one hundred and nineteen of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is, inter alia, enacted that in any case where the local authority of any district desires to construct a bridge, or to establish a ferry or ford, in any position that will, in its opinion, be of advantage or benefit to the whole of or any considerable portion of the inhabitants of an adjacent district, as well as to the inhabitants of its own district, and where it is, in the opinion of such local authority, reasonable that the local authority of such adjacent district should contribute to the cost of constructing or establishing the said bridge, ferry, or ford, the provisions of the said section shall have effect:

And whereas the Oroua County Council has given notice and taken the steps required by the said Act, and has made application to the Governor to authorize the construction of the bridge, approaches, and protective works mentioned in the Schedule hereto, and hereinafter referred to as “the said work,” and to apportion the cost of constructing and establishing the said work between the said Council and the Feilding Borough Council:

And whereas it is also provided in the said Act that the Governor (with the view of determining whether or not the work should be done, or what proportion, if any, of the cost of the same should fairly be borne by any local authority, or what local authority should do the work) may direct any Magistrate or other person to be a Commissioner to inquire into and report to him on the matter:

And whereas a Commissioner was appointed, and an inquiry was duly held, in the manner provided by the said Act, in respect to the said work, and in respect also to the apportionment of the cost of constructing the said work:

And whereas such Commissioner did report to the Governor, after due inquiry, his opinion as to the matters respecting which he was appointed to report:

And whereas I am of opinion that the work should be done, and it is expedient to make provision under the said Act for the purpose and in the manner hereinafter set forth:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby authorize the Council of the County of Oroua to execute the work: And I do hereby declare that the cost thereof, less such contributions as may be made thereto by the Government of New Zealand, and less such other contributions as have already been made by private individuals, shall be borne by the Oroua County Council and the Feilding Borough Council in the following proportions—viz., the Feilding Borough Council shall pay £500
