Exempting Portions of Black's Road and Botting Street
in the City of Dunedin from the Provisions of Sec-
tion 117 of the Public Works Act, 1908.

ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this
thirteenth day of May, 1912.
Present:
THE HONOURABLE T. MACKENZIE, F.R.G.S., PRESIDING IN
COUNCIL.
WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908, it
is, inter alia, provided that the said section shall not apply
in any case where the local authority having charge of any
road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
to any specified part thereof, and such resolution is ap-
proved by the Governor in Council :
And whereas by subsection two of section one hundred
and seventeen of the Public Works Act, 1908, it is provided
that such approval may be either absolute or subject to
such conditions as the Governor, by Order in Council,
thinks fit to impose ;
And whereas on the sixth day of September, one thou-
sand nine hundred and eleven, the Dunedin City Council,
the local authority having control of the portions of streets
described in the Schedule hereto, did by resolution declare
that the provisions of the said section one hundred and
seventeen should not apply to the said portions of streets :
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Act, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution.
SCHEDULE.
ALL those portions of streets in the City of Dunedin,
known as Botting Street and Black's or District Road,
abutting on Allotments 1, 2, 3, 4, and 5 on the plan of
the Township of Maybank, and part of Section 16 of
Block VII on the plan of the Township of Gordon, de-
positcd in the Lands Registry Office, Dunedin, and being
the land comprised in certificates of title, Vol. 34, folio 138,
Vol. 39, folio 10, and Vol. 32, folio 124; as the said por-
tions of streets are more particularly delineated on the
plan marked P.W.D. 30429, deposited in the office of the
Minister of Public Works, at Wellington, in the Provincial
District of Wellington, and thereon coloured blue.

Exempting Portion of the North Side of Adams Terrace,
Kelburne, in the City of Wellington, from the Provi-
sions of Section 117 of the Public Works Act, 1908,
subject to certain Conditions as to the Building-line.

WHEREAS by subsection one of section one hundred

is, inter alia, provided that the said section shall not

of a road or street by resolution declares that the provi-
sions thereof shall not apply to any specified road or
street, or any specified part thereof, and such resolution

clause (b) of subsection one of section thirteen of the
Public Works Amendment Act, 1911, it is provided that
such approval may be either absolute or subject to such
conditions as the Governor in Council thinks fit to impose,
and may refer to one or both sides of the road or street:
And whereas the Wellington City Council, the local
authority having control of the portion of street described

in the Schedule hereto, did by resolution declare that the
provisions of the said section one hundred and seventeen
should not apply to the said portion of street:
And whereas it is deemed expedient that such resolu-
tion should be approved in so far as it refers to the north
side of the portion of Adams Terrace, Kelburne, de-
scribed in the Schedule hereto, subject to the conditions
hereinafter mentioned:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Acts,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby ap-
prove of the said resolution to the extent hereinbefore
mentioned, subject to the conditions that no building, or
part of a building, shall be erect-d at any time within
twenty feet of the centre-line on the north side of that
part of Adams Terrace, Kelburne, described in the
Schedule hereto.

SCHEDULE.
All that portion of Adams Terrace, Kelburne, in the
City of Wellington, fronting Sections 7, 8, 9, and 10,
Block V, Kelburne, D.P. 1185, being a distance of about
2½ chains; as the said portion of street is more particu-
larly d-linedated on the plan marked P.W.D. 31123,
deposited in the office of the Minister of Public Works,
at Wellington, in the Wellington Provincial District, and
thereon coloured red.

Incorporating the Auchmore Land Settlement Association.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this
thirteenth day of May, 1912.
Present:
THE HONOURABLE T. MACKENZIE, F.R.G.S., PRESIDING IN
COUNCLL.
WHEREAS by section seven of the Land Settlement
Finance Act, 1909 (hereinafter referred to as “the
said Act”), it is provided that as soon as practicable after
the complete execution of any agreement under the said
Act, application in the prescribed form shall be made to
the Governor by or on behalf of the purchasers for an
Order in Council confirming the agreement in pursuance of
the said Act : And whereas by sections eight and nine
of the said Act it is further provided that, upon receipt
of such application, the Minister of Finance shall refer
the same, together with the agreement, to the Board of
Land Purchase Commissioners for its report thereon, and
if the Board reports that the agreement is fit and proper
to be so confirmed. the Governor may, if be thinks fit,
by Order in Council confirm the agreement accordingly :
And whereas under the provisions of the said Act an
agreement, bearing date the twenty-seventh day of January,
one thousand nine hundred and twelve, has been
entered into between John McGregor. vendor. of the one
part. and Francis John Goldsack, William Allan, James
Pedley. William Wearing, Thomas Machell Remington,
John William George Bourne, and Thomas William Penn
and Jane Penn, as tenants in common, purchasers, of the
other part, for the purchase of the land therein described,
and the said purchasers therein agreed to become incor-
porated as the Auchmore Land Settlement Association :
And whereas application has been made in the prescribed
form for the issue of an Order in Council confirming the
said agreement : And whereas the said application, to-
gether with the said agreement, was referred to the Board
of Land Purchase Commissioners for its report. and the
Board has reported that no roading is required in respect
of the said land, and that the said agreement is fit and
proper to be so confirmed :
Now, therefore, in pursuance and exercise of the powers
and authorities conferred on him by the said Act, His
Excellency the Governor of the Dominion of New Zealand,
acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby confirm the
said agreement dated the twenty-seventh day of January,
one thousand nine hundred and twelve.
