ition of Wayby Kauri-gum Reserve described in the Schedule hereto be declared to be no longer subject to the said Act, and such resolution was duly gazetted and publicly notified in accordance with section nine of the Kauri-gum Industry Amendment Act, 1910: And whereas no objection has been received to the said proposal:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section thirty-three of the Kauri-gum Industry Act, 1908, and section nine of the Kauri-gum Industry Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of Wayby Kauri-gum Reserve described in the Schedule hereto shall be no longer subject to the provisions of the Acts aforesaid.

SCHEDULE.

ALL that area in the Auckland Land District, containing by admeasurement 1,140 acres, more or less, situated in Blocks VIII and XII, Pakiri Survey District, and Block XVI, Otamatea Survey District, and being part of the Wayby Kauri-gum Reserve set apart by Order in Council dated 11th September, 1899, and published in New Zealand Gazette No. 76, of 14th September, 1899, page 1763. Bounded towards the north-west by the road forming the south-eastern boundary of Section No. 26 in Block XVI aforesaid, from the north-eastern corner of Section No. 31 to the easternmost corner of Section No. 26 aforesaid; thence towards the north generally by the road running easterly to the western boundary of Section No. 4, Block VIII, Pakiri Survey District; thence towards the east generally by the road forming part of the western boundary of Section No. 2, Block VIII, Pakiri Survey District, and the western boundary of Section No. 2, Block XII aforesaid, to Section No. 3 of the last-mentioned block; thence by that section to the road forming the northern boundary of Section No. 4; thence towards the south by the road forming the northern boundaries of Sections Nos. 4 and 11 to a point opposite the northernmost corner of the latter section; thence towards the south-east generally by a right line across the said road and by Sections Nos. 11 and 5, Block XII aforesaid, to the road forming the northern boundary of Section No. 10; thence again towards the south generally by the last-mentioned road to a point opposite the northernmost corner of the said Section No. 10; thence across the road and by that section to the easternmost corner of Section No. 30, Block XVI, Otamatea Survey District; thence by the said Section No. 30 and across a road to Section No. 31; and thence towards the west by the last-mentioned section to the place of commencement: as the same is delineated on the plan marked L. 1911/1229, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Declaring Native Land subject to Part XVI of the Native Land Act, 1909.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this thirteenth day of January, 1912.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, BART.,
PRESIDING IN COUNCIL.

WHEREAS by section three hundred and fifty-three of the Native Land Act, 1909 (hereinafter referred to as “the said Act”), it is enacted that, on the confirmation of any such resolution as is referred to in paragraph (c) of section three hundred and forty-six of that Act, the Governor may, if he thinks fit, by Order in Council declare that the land affected by the resolution shall be subject to Part XVI of that Act as from the date of the Order in Council; and the land shall thereupon, and at all times thereafter while the Order in Council remains in force, remain subject to that Part of that Act accordingly, and all the provisions thereof shall apply in the same manner as if the land was subject to that Part of that Act by virtue of an Order in Council made under the authority thereof:

And whereas by a resolution within the said paragraph (c) of the said section three hundred and forty-six, passed by the assembled owners and duly confirmed by the Tairawhiti District Maori Land Board, it was resolved that the blocks or parcels of land particularized and set out in the Schedule hereto be leased by the said Board under Part XVI of the said Act: And whereas it is expedient that the said lands should be declared subject to Part XVI of the said Act:

Now, therefore, in pursuance and exercise of the powers in this behalf vested in him by the aforesaid section three hundred and fifty-three, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the blocks or parcels of land described in the Schedule hereto shall be subject to Part XVI of the Native Land Act, 1909, as from the date of this Order in Council. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

SCHEDULE.

ALL that piece or parcel of land situate in the Whangara Survey District, containing 326 acres 3 roods, more or less, known as Roto-o-tahi Block, and bounded on the north by the Tuawhatu No. 4B1 Block; on the east by the Tuawhatu No. 4B1 Block and the Pacific Ocean; on the south by the Pacific Ocean, the Puatai No. 1 Block, and the Tuawhatu No. 2B1A Block; and on the west by the Tuawhatu No. 4A Block.

All that piece or parcel of land situate in the Whangara Survey District, containing 154 acres, more or less, known as Puatai No. 1 Block, and bounded as follows: On the north by the Roto-o-tahi Block, on the east by the Pacific Ocean, on the south by the Puatai No. 2 Block, and on the west by the Tuawhatu No. 2B1B Block.

All that piece or parcel of land situate in the Whangara Survey District, containing 54 acres 1 rood, more or less, known as Puatai No. 2 Block, and bounded as follows: On the north by the Puatai No. 1 Block, on the east by the Pacific Ocean, on the south by the Puatai No. 3 Block, and on the west by the Mokairau No. 2 Block.

All that piece or parcel of land situate in the Whangara Survey District, containing 962 acres and 24 perches, more or less, known as Puatai No. 3 Block, and bounded as follows: On the north by the Puatai No. 2 Block, on the east by the Pacific Ocean, on the south by the Puatai No. 4 Block, and on the west by the Mokairau No. 2 Block.

All that piece or parcel of land situate in the Whangara Survey District, containing 1,420 acres 1 rood, more or less, known as Puatai No. 4 Block, and bounded as follows: On the north by the Puatai No. 3 Block, on the east by the Pacific Ocean, on the south by the Pokotakina F and D Blocks, and on the west by the Pokotakina E and Mokairau No. 2 Blocks.

All that piece or parcel of land situate in the Whangara Survey District, containing 211 acres, more or less, known as Pokotakina A Block, and bounded as follows: On the north by the Pokotakina D Block, on the east by the Pokotakina F Block, on the south by the Pakarae No. 1A Block, and on the west by the Pakarae River.

All that piece or parcel of land situate in the Whangara Survey District, containing 231 acres, more or less, known as Pokotakina D Block, and bounded as follows: On the north by the Pokotakina E and Puatai No. 4 Blocks, on the east by the Pokotakina F Block, on the south by the Pokotakina A Block, and on the west by the Pakarae River and the Pokotakina No. 1 Block.

All that piece or parcel of land situate in the Whangara Survey District, containing 79 acres 1 rood, more or less, known as Pokotakina E Block, and bounded as follows: On the east by the Puatai No. 4 Block, on the south by the Pokotakina D and No. 1 Blocks, and on the west by the Pakarae River.

All that piece or parcel of land situate in the Whangara Survey District, containing 160 acres, more or less, known as Pokotakina F Block, and bounded as follows: On the north by the Puatai No. 4 Block, on the east by the Pacific Ocean, and on the west by the Pokotakina A and D Blocks.

All that piece or parcel of land situate in the Whangara Survey District, containing 114 acres, more or less, known as Pakarae No. 1A Block, and bounded as follows: On the north by the Pokotakina A Block, on the east by the Pacific Ocean, and on the south by the Pakarae Nos. 1C and 1D Blocks.

All that piece or parcel of land situate in the Whangara Survey District, containing 506 acres and 20 perches, more or less, known as Pakarae No. 1C Block, and bounded as follows: On the north by the Pakarae Nos. 1D and 1A Blocks, on the east by the Pacific Ocean, on the south by the Pacific Ocean, and on the west by the Pakarae Nos. 2B, 2C, and 2D Blocks and the Pakarae River.

All that piece or parcel of land situate in the Whangara Survey District, containing 331 acres 2 roods 8 perches, more or less, known as Pakarae No. 2B Block, and bounded
