of a road or street by resolution declares that the pro-
visions thereof shall not apply to any specified road or
street, or any specified part thereof, and such resolution
is approved by the Governor in Council:
And whereas by subsection two of section one hundred
and seventeen of the Public Works Act, 1908, it is provided
that such approval may be either absolute or subject to
such conditions as the Governor by Order in Council thinks
fit to impose:
And whereas on the second day of October, one thousand
nine hundred and eleven, the Otaki Road Board, the local
authority having control of the portion of road described
in the Schedule hereto, did by resolution declare that the
provisions of the said section one hundred and seventeen
should not apply to the said portion of road:
And whereas it is deemed expedient that such resolution
should be approved:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise of
the powers conferred by the above-in-part-recited Act, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution in so far as it affects the said portion of
road described in the Schedule hereto.
SCHEDULE.
ALL that piece of road in the Township of Otaki, Otaki
Road District, Wellington Land District, known as Ranga-
tira Street, on which Section 99 of the Township of Otaki
abuts; as the said portion of road is more particularly
delineated on the plan marked P.W.D. 30909, deposited
in the office of the Minister of Public Works, at Welling-
ton, in the Wellington Provincial District, and thereon
coloured red.

Public Works Act, 1908, subject to certain Conditions
as to the Building-line.

At the Government Buildings, at Wellington, this thir-
teenth day of January, 1912.

WHEREAS by subsection one of section one hundred

is provided, inter alia, that the said section shall not
apply in any case where the local authority having control
of a road or street by resolution declares that the pro-
visions thereof shall not apply to any specified road or
street, or any specified part thereof, and such resolution
is approved by the Governor in Council:

thousand nine hundred and eleven, the Wellington City
Council, the local authority having control of the portion
of street described in the Schedule hereto, did by resolu-
tion declare that the provisions of the said section one
hundred and seventeen should not apply to the said portion
of street:
And whereas it is deemed expedient that such resolu-
tion should be approved, subject to the condition herein-
after mentioned:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise of
the powers conferred by the above-in-part-recited Act, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution, subject to the condition that no building
or part of a building shall at any time be erected on the
south side of the said portion of street within a distance
of ten feet from the southern boundary of the said portion
of street.
SCHEDULE.
ALL that portion of street in the City of Wellington,
known as Brougham Avenue, commencing at a point about
2 chains from its junction with Brougham Street, and
proceeding thence in an easterly direction to a point about
1Β½ chains from its junction with Ellice Avenue and Tutch-
Street, being a distance of about 3 chains, more or less;
as the said portion of street is more particularly delineated
on the plan marked P.W.D. 30581, deposited in the office
of the Minister of Public Works, at Wellington, in the
Wellington Provincial District, and thereon coloured red
and lettered A B.

Order in Council making a Treasury Regulation under
Subsection (6) of Section 52 of the Public Revenues
Act, 1910.

ORDER IN COUNCIL.

IN pursuance and exercise of the power and authority
conferred on him by subsection six of section fifty-
two of the Public Revenues Act, 1910, His Excellency the
Governor of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of
the said Dominion, doth hereby make the following
Treasury regulation, and doth hereby direct that this regu-
lation shall come into force on the first day of February,
one thousand nine hundred and twelve.
REGULATION.
Vouchers for the payment of salaries and allowances, ex-
cept those of the Post and Telegraph Department, shall not
be included in any requisition prepared in accordance with
section 52 of the said Act until and unless they have first
been submitted to and passed by the Audit Office.

Terakohe, Golden Bay.

WHEREAS by Order in Council dated the seventeenth
day of January, one thousand nine hundred and
ten, and published in the New Zealand Gazette No. 13, of
the tenth day of February following, the Golden Bay
Cement Works (Limited) hereinafter called "the com-
pany") was licensed to occupy part of the foreshore at
Terakohe, in Golden Bay, as a site for a wharf:
And whereas it is desirable to fix the dues and rates to
be charged for the use of such wharf:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred upon him by the thir-
teenth section of the Harbours Act, 1908, and of all other
powers and authorities enabling him in that behalf, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby prescribe that
the dues and rates set forth in the Schedule hereto shall be
charged and taken by the company, from the date of the
publication of this Order in Council in the New Zealand
Gazette, for the use of the said wharf.
