And whereas the Grey Lynn Borough Council, the local authority having control of the streets described in the Schedule hereto, did, by resolution, declare that the provisions of the said section one hundred and seventeen should not apply to the said streets :

And whereas it is deemed expedient that such resolution should be approved :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that street in the Borough of Grey Lynn, known as Wellpark Avenue, commencing at its junction with Old Mill Road, and proceeding thence in a north-easterly direction, and terminating at its junction with Warnock Street.

Also all that street in the said borough, known as Greenwood Avenue, commencing at its junction with Wolseley Avenue, and proceeding thence in a north-easterly direction, and terminating at its junction with Warnock Street.

Also all that street in the said borough, known as Maxwell Avenue, commencing at the north-eastern boundary of Subdivision 18 of Original Lot 5 of Suburban Section 9, and proceeding thence in a north-easterly direction, and terminating at its junction with Warnock Street.

Also all that street in the said borough, known as King Street, commencing at its junction with Cox’s Creek, and proceeding thence in a south-easterly direction, and terminating at its junction with Richmond Avenue.

As the said streets are more particularly delineated on the plan marked P.W.D. 31471, deposited in the office of the Minister of Public Works, at Wellington, in the Provincial District of Wellington, and thereon coloured red, and lettered A B, C D, E F, G H respectively.

Vesting a Reserve in the Taumarunui Borough Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-seventh day of March, 1912.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, BART.,
PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for water-supply purposes: And whereas, in the opinion of the Governor, it is expedient to vest the said reserve in the Taumarunui Borough Council :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by the fourth section of the Public Reserves and Domains Act, 1908, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Taumarunui Borough, in trust, for water-supply purposes.

SCHEDULE.

ALL that area in the Wellington Land District, containing by admeasurement 27 acres 1 rood 24 perches, more or less, being Section 11A, Block V, Hunua Survey District. Bounded towards the east by Section 5, Block VI, Hunua Survey District, 1654·7 links; towards the south-east, south-west, and north-west generally by Section 11, Block V, Hunua Survey District, 940·7 links, 314·2 links, 235·3 links, 353·1 links, 545·3 links, 413·9 links, 454·3 links, 272·1 links, 249·3 links, and 682·6 links; and towards the north generally by a public road, 348·1 links, 308 links, 620·5 links, and 47·8 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 587/12, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Confering Jurisdiction on Native Land Court.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-seventh day of March, 1912.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, BART.,
PRESIDING IN COUNCIL.

WHEREAS by section one hundred and three of the Native Land Act, 1909, it is enacted that the Native Land Court shall not proceed to exercise in respect of any land the jurisdiction conferred by Part V of that Act unless authorized by Order in Council so to exercise the same in respect of that land: And whereas it is expedient that the Court should be authorized to exercise jurisdiction in respect of the land described in the Schedule hereto :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the said Court to exercise, in respect of the said land, the jurisdiction conferred as aforesaid—that is to say, to determine whether or not the said land, or any part thereof, was, on ascertainment of the Native customary title thereto, intended by the Native Land Court or by the nominal owner or owners to be held in trust for persons not named in the title, and to determine who (if any) are the persons entitled beneficially to the land, and the relative interests of all persons so entitled; and to order the inclusion of those persons in the title, either together with or in lieu of the nominal owners; and, if necessary or expedient, to partition the said land among the persons so found entitled; and for the purposes aforesaid to order the cancellation or amendment of any existing instrument of title, and the issue of such new instruments of title as may be necessary, and generally to exercise in respect of the said land all the jurisdiction conferred upon the Native Land Court by Part V of the Native Land Act, 1909.

And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

Confering Extended Jurisdiction on Native Land Court.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-seventh day of March, 1912.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, BART.,
PRESIDING IN COUNCIL.

WHEREAS by section twenty-five of the Native Land Act, 1909, it is enacted that the Governor may by Order in Council confer upon the Native Land Court, as effectively as if the same was conferred by this Act, jurisdiction in any matter or question affecting the rights of Natives in any real or personal property, and thereupon the Court shall have full jurisdiction and power to determine that matter or question according to law:

And whereas the title to the land set out in the Schedule hereto was duly investigated, and an order in respect of it was made in favour of two persons as trustees for a certain hapu: And whereas various orders were subsequently made, and doubts have arisen as to the legal position of the title as at present disclosed by the Native Land Court records:

And whereas it is expedient that jurisdiction should be conferred upon the Native Land Court to inquire into and determine any matter affecting the rights of the Natives to the land set out in the Schedule hereto:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by subsection
