Exempting Portion of Bay View Road, Northcote, from the Provisions of Section 117 of the Public Works Act, 1908.


ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of March, 1912.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, BART.,
PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas on the fourteenth day of December, one thousand nine hundred and nine, the Northcote Borough Council, the local authority having control of the portion of street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portion of street:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it affects the said portion of street described in the Schedule hereto.


SCHEDULE.

ALL that portion of street in the Auckland Land District, Northcote Borough, known as Bay View Road, commencing at its junction with Waimana Avenue, and running in an easterly direction along the frontages of Allotments 10 and 11 of Section 27, Parish of Takapuna, to Shoal Bay, being a distance of 2ΒΎ chains, more or less; as the said portion of street is more particularly delineated on the plan marked P.W.D. 31415, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red and marked A B.

Exempting Morton Street, in the Borough of Sumner, from the Provisions of Section 117 of the Public Works Act, 1908.

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.


SCHEDULE.

ALL that street in the Borough of Sumner, known as Morton Street, commencing at its junction with Grafton Street, and extending in a north-easterly direction to its junction with the esplanade, all in the said borough; as the said street is more particularly delineated on the plan marked P.W.D. 31259, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.
