Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by section four of the said Act, doth hereby declare that the reserve for municipal purposes described in Part I of the Schedule hereto is hereby exchanged for the Crown land described in Part II of the Schedule hereto, which, in the opinion of the Governor, is of equal value; and doth also declare that the land described in the said Part I becomes and is Crown land freed from all previous reservation and subject to the provisions of the Land Act, 1908, and that the land described in the said Part II is hereby reserved as a site for municipal buildings, being one of the purposes comprised in the said Class I.

SCHEDULE.

PART I.

Description of Reserve exchanged.

ALL that area in the Wellington Land District, containing by admeasurement 1 rood, more or less, being Section 9, Block XI, Town of Ohakune. Bounded towards the north-west by Section 2 of Block XI aforesaid, towards the north-east by Section 10 of said block, towards the south-east by Miro Street, and towards the south-west by Section 8 of said block; as the same is delineated on the plan marked L. 1911/1625, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured red.

PART II.

Description of Land obtained in exchange therefor.

All that area in the Wellington Land District, containing by admeasurement 1 rood, more or less, being Section 6, Block XI, Town of Ohakune. Bounded towards the north-west by Section 5 of Block XI aforesaid, towards the north-east by Section 7 of said block, towards the south-east by Miro Street, and towards the south-west by Titiroa Street; as the same is delineated on the plan marked L. 1911/1625, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured green.

Exempting Moorhouse, James, and Portion of Wade Streets, Wadestown, in the City of Wellington, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of December, 1911.

Present :

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose :

And whereas on the sixteenth day of November, one thousand nine hundred and eleven, the Wellington City Council, the local authority having control of the streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said streets :

And whereas it is deemed expedient that such resolution should be approved, subject to the conditions hereinafter mentioned :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve the said resolution, subject to the conditions that no building or part of a building shall at any time be erected within thirty-three feet of the centre-line on either side of James Street, or on either side of that part of Wade Street described in the Schedule hereto, or on the eastern side of Moorhouse Street, or on the western side of Moorhouse Street from its northern end to the Wadestown Road.

SCHEDULE.

ALL that street in Wadestown, in the City of Wellington, known as James Street, commencing at its junction with Moorhouse Street, and proceeding thence in an easterly direction for a distance of about 258 links.

Also all that portion of Wade Street commencing at its junction with Moorhouse Street, and proceeding in an easterly direction for a distance of 774 links, to its junction with Wadestown Road.

Also all that street known as Moorhouse Street, commencing at its junction with Wade Street, and proceeding in a northerly direction for a distance of about 27 chains 37 links.

As the said streets and portion of street are more particularly delineated on the plan marked P.W.D. 30722, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Fixing Open Season for Godwits (Curlew).

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of December, 1911.

PRESIDING IN COUNCIL.

WHEREAS by an Order in Council dated the eighth day of August, one thousand nine hundred and ten, made under the Animals Protection Act, 1908, it was ordered and declared that the season during which godwits may be killed shall be the first day of February to the thirtieth day of April, both days inclusive, in each year :

And whereas it is expedient to amend the said Order in Council :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Animals Protection Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the season during which godwits (Limosa Nova Zealandiæ; native name kuaka or hakaka) may be killed shall be the first day of January to the thirty-first day of March, both days inclusive, in each year :

Provided, however, that no such birds shall be trapped, netted, snared, or taken by any other means prohibited by the Animals Protection Act, 1908.

Licensing Hugh Paterson to use and occupy a Part of the Foreshore, Purakanui, as a Site for a Boat-shed and Slip.

At the Government Buildings, at Wellington, this twenty-second day of December, 1911.

PRESIDING IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under the Harbours Act, 1908 (hereinafter called “the said Act”), Hugh Paterson (hereinafter called “the licensee”) has applied to the Governor in Council for a license under the said Act to occupy a part of the foreshore at Purakanui, in order to construct a boat-shed and slip thereon; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited a plan in the office of the Marine Department, at Wellington, marked M.D. 3788, in duplicate, showing the area of foreshore intended to be occupied, and the manner in which it is proposed to construct the said boat-shed and slip : And whereas it has been made to appear to the Governor in Council that the proposed work will not be or
