Special Order made by the Remuera Road Board, County of Eden, making By-laws.

THE following special order, made by the Remuera Road Board, is published in accordance with the provisions of the Road Boards Act, 1908.

REMUERA ROAD BOARD.
Building By-law relating to Minimum Areas.
THE Remuera Road Board, in pursuance of the Public Health Act, 1908, and its amendment, the Road Boards Act, 1908, and of every other power (if any) thereunto enabling it, doth hereby make and ordain the following by-law :—
- In these by-laws, if not inconsistent with the context, the following words and expressions shall have the meaning hereby assigned to them, that is to say,—
"The Board" means the Remuera Road Board ;
"The District" means the Remuera Road District ;
"New house" shall have the meaning assigned to that term by certain by-laws of the Board made by special order on the 7th day of March, 1910, and confirmed on the 28th day of April, 1910.
Words importing the singular number shall include the plural, words importing the masculine gender shall include the feminine, and words importing a person shall include a company and a corporation.

Paragraph (d), clause 2, of the by-laws made by the Board by special order on the 7th day of March, 1910, and confirmed on the 28th day of April, is hereby revoked, and clause 1 hereof and the following clauses substituted in lieu thereof.

No person shall within the district erect any new house upon any land, unless such land has—
(a.) A frontage of not less than 50 ft. to some public road ; and
(b.) A mean average depth, measured from the line of abutment upon such road, of not less than 132 ft.

Nothing herein contained shall be construed so as to prevent the erection of one new house upon any area which does not conform to the requirements of clause 3 of these by-laws, provided that such area is shown as a separate and distinct area or subdivision on any plan deposited in the Land Transfer or Deeds Registration Office at Auckland before the publication of these by-laws in the New Zealand Gazette.

It shall not be deemed a breach of these by-laws to erect a new house upon any land situated partly at the back of any other land immediately abutting upon any public road if such first-mentioned land—
(a.) Shall not have a frontage of 50 ft., but shall have a frontage of at least 10 ft. to such public road ; and
(b.) Shall not be less than half an acre in area. And such area shall be computed so as to exclude the whole of any entrance or right-of-way giving access to such back section.

In any case where there are two adjoining allotments one of which is situated partly at the back of any other allotment immediately abutting upon any public road, and the other situated partly at the back of such first-mentioned allotment, and each of them has a frontage of less than 50 ft. to a public road, it will be sufficient if each of the said allotments has a frontage of at least 8 ft. to a public road ; provided such frontages adjoin for the full distance intervening between such public road and the first-mentioned allotment, and are thereafter kept adjoined ; and provided that the area of each of the said adjoining allotments is not less than half an acre ; and provided that not more than one house shall at any time be erected on each of the said allotments. In computing the said area the whole of any entrance, right-of-way, or approach giving access to any of the said back sections shall be disregarded.

Where any new house shall be erected upon any land in conformity with these by-laws, no person shall reduce, or cause to be reduced, the area provided for thereby so as or in such manner that such area shall be or become less than the minimum area hereby provided for ; and such minimum area shall be exclusively maintained as the curtilage of and shall be exclusively appropriated to every such house.

Where any new house shall be erected in conformity with these by-laws upon any land, no person shall sell or dispose of any estate or interest in any portion less than the whole of any minimum area provided by these by-laws.

Where any new house shall be erected in conformity with these by-laws upon any land, no person shall purchase or acquire any estate or interest in any portion less than the whole of any minimum area provided for by these by-laws.

Clauses 6 and 7 of these by-laws shall not apply if no house shall be upon the land at the time of such sale, disposition, purchase, or acquisition.

If in the opinion of the Board the configuration of any land is such that the enforcement of a compliance with these by-laws or any clause thereof would operate to the inconvenience of any person, and it appears to the Board that the public health and the sanitary requirements of the district can be conserved by the relaxation of these by-laws, or any clause thereof, and the imposition of other terms and conditions, the Board may accordingly by resolution relax the same upon such terms and conditions as it may impose ; and these by-laws shall, so long as but no longer than such terms and conditions are observed and complied with, have no application ; and no person shall at any time make, cause, or suffer any default in the observance of or compliance with the said terms and conditions or any of them.

These by-laws shall apply to the whole district. They shall come into force upon their being gazetted.

If any person shall commit a breach of any of these by-laws he shall be liable to a fine not exceeding £5, and in case of a continuous breach to an additional fine not exceeding £5 for every day on which the breach is continued after the first day. The continued existence in a state contrary to any by-law of any work or thing shall be deemed a continuous breach within the meaning of this clause.
The above by-laws were made by special order of the Remuera Road Board, the resolution to make them having been passed at a special meeting of the Board held on the 28th day of August, 1911, and confirmed at a subsequent meeting thereof held on the 9th day of October, 1911.
The common seal of the Inhabitants of the Remuera Road Board District was affixed hereto at a meeting and by order of the Remuera Road Board held on the 9th day of October, 1911, in the presence of—

Resolution made by the Council of the Borough of Waimate.

THE following resolution, made by the Waimate Borough Council, is published in accordance with the provisions of the Local Bodies’ Loans Act, 1908, and its amendment.

BOROUGH OF WAIMATE.
Certified Copy of Resolution.
THAT, in pursuance and exercise of the powers vested in it in that behalf by the Local Bodies’ Loans Act, 1908, and the Public Health Act, 1908, the Waimate Borough Council hereby resolves as follows : That, for the purpose of providing the interest and other charges on a loan of £3,000, authorized to be raised, under the above-mentioned Acts, for construction of drainage-works for portion of the Borough of Waimate, the said Waimate Borough Council hereby makes and levies a special rate of ½d. in the pound sterling upon the rateable value of all rateable property of the Borough of Waimate, comprising the whole of the Borough of Waimate ; and that such special rate shall be an annually recurring rate during the currency of such loan, and be payable half-yearly on the 1st day of April and the 1st day of October in each year and every year during the currency of such loan, being a period of thirty-six years and a half, or until the loan is fully paid off.
